why can businesses sue these cities? Wouldnt the company want the city to lay the groundwork so it is cheaper for the teleco?

Mostly because these cities politicans have been bought by the telcos and cable companies, passing "Anti Competition" legislation.

Imagine for just a moment if these clowns would have spent a fraction of the money they've wasted trying to oppose muni broadband options, and invested it in their networks?

sounds like there should be a good for the community clause or technology advancement clause that would help the community . Like emminant domain for internet lines. If the teleco is not going to fix the blight the city will(blight as being slow copw lines)

Duluth, GA		 I thought Utah's project Utopia acted as you are describing, which means the municipality installs the facilties and provides wholesale access to anyone and everyone for resale of services.
