The FCC is clearly overstepping its mandate. If it wants to start regulating domains outside its purview, Congress has to pass a law authorizing it to do so first.

While we're at it, how about regulating the ILECs so the consumer can stop getting boned in the rear end?

Refreshing to see a judge to look at the intent of the law (statutes) from the (from the legislative) and the regulations that implement the law (from the executive.)
