Primus DSL Usage (re-visited)

For what it's worth, I was part of the group that Primus attempted to extort extra bandwidth charges from with their "apparent" policy change in November '05. My original post was as "RipT0rn". I don't know how others have faired in their battle, but I just wanted to update my story a little.

Yes, it's been 6 months. Primus is *still* after me for $664.04 for the apparent "extra bandwidth, billed at $1.95/GB" and has proceeded to sick a collection agency after me (as of last Thursday). They claim to have "backup paperwork" which I have not yet seen, claiming I now owe Primus for long-distance service.

Over the past 6 months, I've received 2 phone calls from Primus asking if I had made any payments towards the account (my response, "Nope"). I've received 2 "Important Notices" from Primus, the first was requesting $664.04 for my long distance service (which I've never had) and the second was threatening disconnection of my long-distance service (which I've never had) for non-payment (which was disconnected back in February). I still have yet to receive an actual invoice or any relevant paperwork of any type from Primus.

About a month ago, I got the University of Calgary's Student Legal Assistance involved and they are helping me out (and getting a complete run-around by Primus in the process). I'm still waiting for delivery of the supposed "backup paperwork" from the collection agency.

Has anyone else had any luck with their situation?

This just gets better and better.

Back in November '05 when I first signed up w/Primus, I repeatedly told them I didn't need their modem package because I was going to use an old Telus DSL modem. They ended up sending me the package anyway, which I refused delivery of. I have to assume it went back to them via Canada Post.

A few weeks ago, my Student Legal rep informed me that a $175 credit had been applied to my account, bringing the balance owing (according to Primus) to $489.04, but she did not know why the credit was applied.

Fast forward to yesterday: I haven't heard from my Student Legal rep for a week, so I decided to call her. I was told that all their case workers are gone until Sept. 18th... Wonderful! I'm sure Primus and the collection agency will wait patiently for her to return.

So, I called the collection agency to inquire where the supposed "backup paperwork" is (they are in Calgary, I'm in Calgary... it shouldn't take 7+ days to mail documents). I was told they hadn't received the requested documents from Primus yet, and that I would be contacted on Monday.

So, as I have done every month or so, I decided to call Primus again and ask what they think the balance is *this* time. I was told about the $175 credit and asked what it was for... It was for the modem package and was applied July 28th?!?! Yeah, the modem package that was sent back to them IN NOVEMBER 2005! Add that to the fact that when I cancelled the service on Feb. 21st, the sent me an envelope and letter asking for thier modem back and threatening to charge me $175 if I didn't -- holy crap! -- I called them at that time and (thought) we got it straightened out.

What the hell is up with Primus? It has taken them 9 months to realize they've had the modem this whole time? Now they're claiming I owe them for long-distance service that I've never had? And the collection agency wants the original $664.04, yet Primus has adjusted that to $448? ARGH!

In all honesty, this doesn't bug me so much for what it should. It bugs me because it's taking SO LONG to get ANY information or resolution to this? Are the people at Primus REALLY THIS STUPID? Push push push, go ahead Primus. Unless a Judge orders me to pay you, you will NEVER get a single cent from me because you've once again showed me exactly how dissorganized and stupid you really are.

For what it's worth,

We had a similar problem with Primus it was for long distance though. We had tried to switch to another provider and everytime the switch would happen Primus would automatically switch us back and bill us. After they did this twice, I wrote them a letter saying that the next time they do this I will not pay for the long distance because I do not authorise them to be our provider.... So they switched us again, when the bill came I refused to pay. They gave it to a collection agency and I just told them they can take me to court to try to collect the money since I had not authorised them to be my LD provider.

Anyway, you can let them run around all they want, they can't do anything to you and from my experience with them they will try hard but at the end they will realise that they're not gonna win.

All i can really say is (if you have not already) call Primus and speak to the highest person you can get on the phone. Then also e-mail the highest guy explaining your problem.

see if that helps at all. Its worth a try if you have not already done it.

Make sure you get your free credit reports, make sure Primus doesn't have an entry, and if they do, dispute it with the credit bureau (Equifax/Transunion)

@Muzzy: Why doesn't that suprise me? I think Primus is just a shell company that entices people to sign up for their services and when they go to cancel, they stick it to you however they can to keep the $$ flowing in their direction. If you disagree with anything they say, they attempt to bully you into forking over more $$.

@bwyanviper: I've already done this, 10x over. I've talked to CSR's, who transfered me to credit & collections, who couldn't make a decision. I even had them discuss it with their supervisor (who they wouldn't let me speak with). They provided me with an e-mail address (no telephone number) for an "Advertising" person, who I did e-mail. About 3 weeks later (after a phone call from me to find out wth was going on) I got a response from some Primus Executive Response person named Natalie Martin saying that they had reviewed my account and determined that I was responsible for the oustanding charges. I immediately withdrew my previous offer of paying the $26.70 for February service, which they still have not charged me for, on the spot. I told them they can consider that the cost of my dealing with the complete incompetence that is Primus Canada. They will not get any $$ from me, ever.

@Crown and Anchor: Got my credit report about 3 weeks ago from Equifax... Nothing by Primus as of then. Though that was about 1.5 weeks before the call from D&A Collections; I wouldn't be suprised if their inquirey is now on my record. It will be removed, no matter what it takes.

Make sure you get the one from TransUnion too.

Well, in the past 3 weeks, I have received 3 "Collection Demands" from D&A Collections. The latest one claims that "if this matter is not rectified within the next 48 hours, [D&A] will have no alternative other than to inform [Primus] to take necessary steps in recovering this account." You know what? Bring it the f**k on. Maybe, just maybe, I'll see Primus in court and actually see some paperwork!

My U of C Student Legal Case Worker hasn't contacted me (which they said would happen by October 9th) and I still have not seen any paperwork from Primus.

If anyone is interested in viewing any and all documentation that has been transmitted back and forth since February, I'm opening up my website, which amounts to 9 letters and a whole 4 e-bills, it's open at »primus.tigercore.net. This is the site with complete documentation that I have provided to CTV Consumer Watch and Global News Consumer Advocate, and my U of C SLA Case Worker (as useless as they are).

No, I haven't edited any of my personal information. We just moved ~2 weeks ago and I don't give a turd about anyone on the 'net knowing my old address

to destroy your credit rating by saying
you balked at paying your debts.

Next time you apply for a credit card, a mortgage,

And I am entirely within my rights to sue them for defamation of character; Primus/D&A can't simply claim something like this and expect it to stick. Without supporting paperwork, the credit agencies will laugh at them. I know Primus has no supporting paperwork, so I'm not at all concerned.

Got two, got one, don't need one. As informed by 3 lawyers now, anything D&A/Primus puts on my credit history, will stick for a maximum of 7 years. A letter or two to credit agencies proving lack of supporting documentation and it will go away even sooner. The worst they can do is put a "bad" letter in my credit history... Big deal.

Not looking for a flame war, but the majority of complaints concerning Primus are all based in the West. Note I said the majority, not all.
