It's not illegal to listen to cell phones, only to record them for anything but personal use. If I record your cell phone conversation and then through it up on youtube then I'm in trouble. Recording as a 3rd party is wire tappings period.. no matter how you justify it. All states have at least a 1 part rule, about 10 or less have the 2-party rule. NONE have a 3rd party rule.
Tapping into conversations AND "recording" them 'for any purpose' is a ticket to being bubba's wife.
According to your post, it's ok as long as you don't get caught.

| In Ohio its legal for you to record any phone convo you want as long as ONE party on the phone knows. So basically I could be talking to you and 2 other people on the phone, and as long as I would know (duh) I could record your convo under Ohio law. And in Ohio it protects me. Nothing else you could do- under our laws. |
