WARNING New/Potential DSLX users

Here is what DSLX's TOS says: "Subscriber must pay ninety-nine dollars and ninety cents ($99.90) plus applicable taxes to purchase any modem Subscriber does not return to DSLExtreme in working condition within such thirty (30) day period" HOWEVER - here is the reality: My service was disconnected by my new ISP on 15 August, my DSLX account ended 1 September, but my credit card was CHARGED $99.90 on 14 August!!! Yes, it was CHARGED a day before I was disconnected and a full two weeks PRIOR to the termination of my account!!! After calling and arguing with Bianca at billing, I was able to get the charges reversed because THEY HAD ALREADY RECEIVED THE MODEM I HAD RETURNED!!!! This is the unconsionable behavior you can expect from DSLX!! Not only do they have horrible service and tech support - but they make an active effort to get revenge when you leave them. They are VERY vindictive!! BTW, Verizon's offers the same connect speed as DSLX for $10 a month cheaper!!! You will read after this posting the responses of the undercover DSLX employees who will flame me and you will read the "official" response which will try to cover up for their bad behavior - don't be fooled!!!

I have opened a yahoo account for anyone interested in beginning a class action against this unbelievable behavior. It is naildslx@yahoo.com. If you have had similar misconduct from dslx, send me an email outlining what happened and when I get a pro bono attorney to handle the case we will contact you for further info. I haven't had the opportunity to contact an attorney, but I feel certain that my situation could in fact be against the law. I also plan to pursue action with the FCC and any other federal/state entities I can. So let me know what your story is and I'll pass them along also.

Didn't we already cover this in the other thread you started? Let's go over the facts again. DSLX charged you the $99, before they should have. You called and they reversed the charges. What exactly are you going to sue for again? How do we know you aren't just a verizon undercover employee trying to make DSLX look bad?

Fraudulent? maybe i am wrong but dslx acknowledge mistake of charging your early, you can rant all you want, you just started rant in wrong forum. You can sue all you want, but you got no case. You not going to find a lawyer that will take this case as dslx broke no laws, violated no fcc rules. You absolutely got no case, at most you can file bbb complaint but being dslx acknowledged and fix their error, you have nothing to even complain about to bbb. As for paycheck, that is great idea, can you tell me where i can pick on up?

It would be fraudulent if they refused to give you back your money - and as yuo admit - they din't do that but instead fixed it and returned your money....

Therefore - not fraudulent, the FCC has nothing to do with this, AND there is no issue for a "class action lawsuit" since they fixed their error.

BTW - I am not a DSLX customer nor was I ever...

If the company makes a practice of charging a person's credit card when they aren't supposed to, that's not a mistake - that's theft. Go for it, but you should file with the Public Utilities Commission and maybe make a complaint with the credit card company too.

No, it's a mistake, a theft would be charging him and then claiming they never did etc.

Well, it does look like they refunded his money, but if they do unnecesary billing as a policy, then I'd say that isn't a mistake. That's the problem with using credit cards, some companies and their employees can't be trusted with them.

Actually - that is the benefit as you can easily dispute the charges - another layer of protection for the consumer.
