Unfortunately, I think LimeWire will lose this one. It would be better if this lawsuit were to play out in Canada, where copyright laws are much more lenient.

Technically the creator is in a country where they had no laws against piracy I still don't know why they are able to sue. I believe hes in Costa Rica..? Correct me if I'm wrong

Hmmm. There's bigger issues at stake, don't you think? What you've said is kinda like someone saying "I am sick and tired of people speeding in their cars up and down my street.... I hope they ban automobiles!"

For the good of consumers and the U.S. populace in general, it would be great if limewire wins... So defeat is probably a certainty.

Limewire may or may not successfully defend itself on the copyright issues and charges it is aiding and abetting copyright infringement. The Grokster case revolved around a centralized directory and the fact that Grokster had control of it. That got them in trouble. Limewire claims it has no control at all over a centralized directory of any sort, therefore the Grokster ruling doesn't apply. The courts may not agree and may base their decision on INTENT of Limewire to aid and abet copyright infringement and not on any technical control issues. Facts submitted about their advertising methods may determine whether they win or lose.

As far as counter-suing claiming antitrust, they are on shaky grounds. Industry associations and trade groups like the RIAA have been found legal over and over in the courts as long as they didn't hold meetings to set prices or exclude companies in the industry from joining the trade group. Companies in the industry, in this case, comprising music companies that own copyrighted material. Limewire wouldn't fit into the trade group since it is not a company that owns copyrighted music.

Every machine I get a call on to clean or repair has Limewire or eMule on it. Teens using it for getting music and apps. I even know a colleague that instead of getting a demo or buying something to use, goes to Limewire religiously. Asking for trouble.
If anything, Limewire should sue for entrapment, service tampering (as I am 90% sure RIAA has someone uploading trojans as mp3 files).Songs shouldn't be executables.
Can't blame the kids though. Many teens have no clue (look at study about remorse/consideration lacking in teen development) and just want peer acceptance.
What I want to know is, how does Limewire make any money? Are they selling ads in their P2Pware? Or selling IP information?
Yeah, goodluck LW. I wonder if they took the image for their logo from some pirated photo-clipart CD...

Maybe you should be a PARENT to your children, rather than forcing the "village" to go without because of your unwillingness to do so.

Take their computers out of their bedrooms and put them in a family area where they can be watched. Don't give them administrative-level accounts so it's harder for them to install things. Take them away if they abuse the privilege. Geez.

"Burying" useful technologies because you have no control over your children seems a bit Draconian, don't you think?

Agreed....put them on a limited account (if you are running Win2k or XP). Had to do that for my stepson when he got my puter infected awhile back.....if he wants something installed, I have to do it...

Said like someone without children or an understanding of what it takes to control kids internet activities.

I use access-lists that only allow the kids PC's to go out http, https, AIM or MSN IM and for good measure their user profiles do not allow them to install programs.
