I don't see any chance of this making it into the final EULA when Vista goes to actual release... I am always skeptical of any EULA that is posted and commented on before the final release of the product...
This is just shooting themselves in the foot - although it would almost make sence if they keep DX10 being a Vista only release as most gamers would be forced to go to Vista within a year or so to take advantage of the gmaes coded to DX10...
