I don't think that these rulings have a bearing on the AT&T project anyway. This is part of their network upgrade..

What I don't get is in my sister's neighborhood, telco and cable run in the easement along the back of the property, but electric runs up in the front of the property about 3 inches from the sidewalk. Tacky as hell if you ask me.

I have a huge transformer literally in the middle of my front yard. I also have a telco and cable ped at the property line. Big whoop.

But, the thing that these people don't get is that it's not on "their yard"... it's in the easement which they technically don't have ownership / rights over in the first place.

The courts have ruled that an easement is restricted to the stated purpose. For instance, All those companies laying fibre optic lines next to Railroad tracks got a BIG surprise when the courts ruled against them (in favor of the landowners). I.E. The Railroads had no rights to add fibre to their easement.

Yea... no kidding, huh?

I can recall being bitched at, screamed at, and made to feel that I was murdering someone's child because there was a 1' green pedestal sticking out of the ground in their yard. However, it was 16" away from the sidewalk and mostly in the center part between the two houses. (Yes some are bigger as we know) but it's a fact of life. These boxes have to exist.

The other alternative, in SOME cases, is to put the services back on poles. It would eliminate much of these horrible life ending access peds as they are now, but then people would have to complain about the poles and the over head drops to the house instead.

But, I can certainly see if these peds are placed in inconvenient places, as I've seen some, where they are right on the end of their driveways so they are constantly hit by cars. Other than that, my attitide is so what. I've got all three in my yard AND a manhole but life goes on.

The funny part is these aren't placed in the front lawn. Those type of boxes are placed on side of houses or around back. They're few and far between. The electric company has a bigger footprint then the cable and telco RTs. Every couplehouses have to have a 3x3ft transformer. For the other guys it's 1 big box for several hundred and plenty of small ones.

It's funny you mention that. On my yard there is a nice big blocky looking box that belongs to the power company. I'm guessing it is some kind of transformer although that doesn't matter. I suppose if I want to indulge in a luxury such as electricity, I will have to put up with said box

Actually... it doesn't bother me at all.

If the phone companies want to play nice and good neigbor, they will, and mostly should. HOWEVER, home owners, scratch that, INEXPERIENCED home owners should know that "lawn ornaments" are a fact of life. SOme people wind up with them, some don't. But, the thing that these people don't get is that it's not on "their yard"... it's in the easement which they technically don't have ownership / rights over in the first place.

Some reasonings that creack me up, as well, is ..

"They have no right"
"Well, *I* don't use / I don't want their service, get it out"
"It's ugly" - no kidding?
"I'll just bury it" or "I'll plant rose bushes around it" and then do.

Some people think that since it didn't exist before that it doesn't have a right to now. Or, that if something is the way it is, it will always be.. when they do in fact reserve the right to make changes..

This battle will go on, people will meet over it, and money and time will be wasted.. someone will even devote their cause to getting rid of these boxes.. however, AS ALWAYS, it will go no-where and the boxes will remain.

Yes, you are right. All of the people of Irvine, CA, who oppose cell phone towers actually work for the NSA. The NSA of course, overruled the FCC when it came to putting up a cell phone tower in their town.

Cell towers here are few and far inbetween because "they are ugly".
I'll bet the same people also whine equally hard about cell phones not working.

I always thought the FCC could overrule any local or state restrictions on cell tower placement.
