Dude, read the article.
The reason she won is that the company DID have a AUP (Acceptable Use Policy), but never told the employees that they are monitoring all communications. Because of that, the the court ruled that she had "A reasonable expectation of privacy", hence the ruling under Article 8.
In the States, as long as the AUP for the company says you all communications are being monitored, you can pretty much snoop on anything they are doing from a corporate asset. -- The tree of liberty must be refreshed from time to time with the blood of patriots & tyrants.
