No, they don't need to give 30 days notice.

Note that this is anonymous rumour at this stage. It was supposed to start happening this fall ... they still haven't got the usage meter working properly.

meaning that if they Charge for going over you can take them to court because the usage meter is not 100% working.
so you and rogers dont know the real usage unless you run a Usage Program on your computer(s).

and users can use the BBR website as evidence to it not working 100%

Actualy I do belive that under the new comsumer protection laws they do need to give 30 days notice of the emplamentation of the charge for overage program. Till now they have only said that charges may apply and have yet to charge overage on Extreme or below accounts.

Looking at the Consumer Protection Act (which is a real mine field!), while this is true, the thing is that the basis on which they are implementing this ALREADY exist in the terms of service, so this is not an amendment as such.

One interesting thing though is that when they DO make amendments, renewals or extensions, they must offer you one of cancellation, or acceptance of the service unchanged.

I belive that if you chose to cancle the service for a change of service matter that they are unable to charge you any penalties

You can argue that you shouldn't be charged ... but they CAN and WILL do so.

If they implament a change in there TOS (This would include caps, charges ect...) and if you disagree with these changes you are able to terminate your service. Since usage of the service on your part indicates that you agree to comply with the TOS (as per the TOS). You have no other alternative but to cancle your service with them. Since they have change the service that you are paying for any previous comitments or contracts should be null and void should you decide not to accept the new TOS. I'm prety sure that is covered in the consumer protection act.

There's nothing in the CPA that suggests that they can't charge any early termination fees. Therefore, you SHOULD be able to continue on AS BEFORE.

Implementing caps and charges etc is still within the existing terms of service ... that's the problem.

I think the Linksys WRT54G with Tomato firmware can show the amount of bandwidth used as it has a Bandwidth monitor right in the router. Support some of the Buffalo routers too.

Yes, it can. The Bandwidth History log (daily, weekly or monthly with user selectable start of monthly cycle date) is for WAN port bandwidth only. LAN traffic log is only kept for the last 24 hours.

Actually, the excellent bandwidth monitor is the main reason I chose Tomato firmware over others.

To just get the WAN bandwidth monitoring would I just exclude br0, and eth1? That would just leave vlan1. Correct?

Yes, I use Tomato as well to track my bandwidth. But I do notice some differences in tracking from Tomato compared to Rogers, mainly due to upload portion. For example, Tomato would report 0.5GB while Rogers would only report 0.3GB. And over the course of the month, the Tomato bandwidth would over-estimate my bandwidth usage compared to Roger's Bandwidth tracker. But it's still a good indicator when Roger's bandwidth tracker screws up.

I think the difference in reporting from Tomato and Rogers has to do with the network. For example, Tomato tracks everything that is leaving your IP including connections within Rogers' network. While I think Rogers' bandwidth tracker only track what leaves their network. What do you guys think?

Nope. Rogers tracks everything through your modem. They *may* be subtracting an allowance for things you can't help.

Yes they do substract an allowance for internal traffic...That they have no choice about..... Usually things like ARP packets and any number of other bits and bytes that could possibly get added into your monthly total.... All providers do this as standard practice....If they didn't you could easily loose 20 GIGs or more a month of your cap depending on the type of network......

And as a quick side note Cellular providers to them same thing with certain types of traffic with PDA and non PDA based devices.....(and yes rogers is included in that)
