The state PUC would have to change the law to regulate FIOS, and if it did, the FCC would strike it down instantly, the FCC promised that next gen broadband/telco tv infrastructure will not be regulated by the FCC (and therefore any state or local govt), otherwise Verizon and ATT would have never built any of it, it it had to resell it to CLECs. |
