I especially can't believe the Bell arrogance in their statement...
"In Bell Canada's view, there was no evidence to support CAIP's arguments that there were difficulties in managing service to end-customers or that reductions of traffic volumes delivered to Internet backbone providers were causing CAIP's members to pay for capacity that they could not actually use. Bell Canada submitted that even if there was financial harm resulting from delivery of reduced traffic volumes, the harm would not be irreparable because CAIP's members were obligated to pay for contracted transit capacity and GAS whether interim relief was granted or not.
That's like saying "Although we're squeezing your nuts in a vise, you're still contractually obligated to sing Basso profundo".

| reply to tertech The response seems to be all about the "Irreparable harm" from the RJR case history.
Without every member opening its books for full scrutiny by Bell Canada and amongst their own competitors there's no way to provide proof of harm or irreparable harm, which itself could cause irreparable harm!
In a perverse way this may in fact be the way NOT to produce irreparable harm to the CAIP members ... now anyone who considered leaving Bell is far more likely to, to support the CAIP members. |
