Re: Apple says it is illegal to jail break an i Pod touch

I'm not sure why anyone would find this surprising. Apple is one of the most DMCA-pro companies out there. But they are not alone. If I wanted to modify my Windows UI on a licensed copy of XP/Vista I am sure doing so would get the same response from Microsoft. Same probably would be said if I wanted to modify my DirecTV HD DVR.

Last time I checked, the DirecTV Dvr is mostly built on open source software.

But, last time I checked was years ago.

The difference here is that you don't own Windows XP/Vista, you are simply licensed to use it.

You buy a piece of hardware, you own it and can do anything you want with it. However, if the licensing of the software/firmware which runs upon it restricts you from tampering with it, you can't legally tamper with it. Tamper with the hardware all you want, because it is yours.

Not saying that I agree this is right at all, just saying that it is what it is.

I tamper with OS installed on mine computer the very first minute I've entered my account name into it. Then I tamper it all the time - I modify registry settings (directly or indirectly), I add and remove components, I'm analyzing how it works (or, in some cases, do not) regularly, etc. It's mine copy of OS running on mine computer and I modify it as I want. And it's completely different now from the copy that I've purchased.

I do the same thing

As I said, its not that I think it's right that we aren't supposed to tamper with software which we have a license to use, but that's the way it often is, unfortunately.
