It still stands that without some kind of disincentive (ie. ticket), there's no reason to the individual to obey them. If cops could only issue roadside lectures, the masses would take speed limits with a grain of salt.

What "soft" caps are these, and what's to prevent their customers from going ludicrously over them every month without fail? Are they really caps at all then, or merely dismissible suggestions?

"Soft" means that even though there are 250GB caps, cable co's won't charge you overages, or even bother you unless you are clogging a node. At least they have a half-assed excuse for having caps. As I already stated, I don't give two sh*ts about how AT&T is to enforce their BS policy.
