Most states have a $500 minimum loss, for a company to file a felony theft charge. This amount varies however so I would say that out of all of there service areas the highest necessary loss was $650 dollars. So in order for them to file a felony theft charge against a customer that skips town with there product they would need to value the modem at $650. This is also related to the fact that you can not effect a person's credit rating for merchandise that was at one time rented but not returned. So the only legal recourse is to either bill you for the amount of the modem, $150, and have them skip town and only be able to file a misdemeanor which does not follow you through life or charge the value of the felony. This felony idea is to increase the odds of getting the merchandise back, NOT TO GET THE MONEY. So as long as you are a honest person and return your modem you will never have a problem. |
