... because in using the D.M.C.A. as they are, they are *proving* the critics charges that the DMCA is unconstitutional. Using copyright infringement charges to block free speech probably wouldn't sit well with many judges.... and that's exactly what the Scientologists are trying to do, is silence anyone who speaks out against them.
Maybe a case like this will go to court and the DMCA will be *overturned* on a Constitutional basis! Here's hoping it is so! |

there is quite a bit of copyrighted material at xenu.net if you click around and look at the whole site you will find a fair bit of it... i do believe that it is fair use, but the case does have a *tiny* bit of merit
i think the DMCA is a poorly written law and would love to see it ruled as unconstitional eventually, but it wont come as a result of this case, it will simply be ruled in favor of one of the two parties |
