Do not even have to have anything on it (the computer), with a warrant and 'due cause' they can take the computer and have it tied up as evidence for a long time. All it takes is an 'expert witness'.

| they need a warrent to enter, i myself have a PC with music files, but i dont share them i only download then close the program. i can ping it on my network but its missing somewhere in the house.......

Just that the way the laws are written now, the police/FBI/other John Law can with 'due cause' (that is in quotes because many, including many cops apparently do not believe that it is truly due cause) be issued a warrant and told to go get your computer (and you too). Then with the backlog of court cases, your machine is tied up as evidence until after the trial or whatever is finished.
Thus far to the best of my knowledge this has only been done for true criminals and kid porn, but technically it can be forced if the RIAA and associates want to do it. And remember, in the US of A, money talks very loud, unless you can change that to being picked on because you are in certain minority groups.
This is from just one law enforcement source, I do not know how other areas of the country feel about this. And a good lawyer may be able to circumvent some of this.

Yes they do need a warrant, and the fact that you downloaded files without paying the RIAA et al for them now makes you a hardened criminal. Somehow I do not think that was the original intent of the laws, but that is what the interpretation looks like it is being forced to.

I should've been more clear---How can they justify a
search warrant when the computer has no copyrighted/illegal
material on it ?

True, one would be scared. But I'd insist that they take all the computers in the garage also - several old 8088's, wang pc's, 80286, 80386's and some 80486's. My wide would most likely be very happy to get rid of my old "parts" pc's that could still work, but haven't been turned on in years. One question? Would I have to accept having them returned to me? I have about 50 of 'em but it's a lot of work to take them out to the recyle station. |

That is a question I can not answer, do not know anyone in that field. Be an interesting way to get rid of junk (assuming you had your real machine hidden and a dummy in place).
