Here's what im wondering... if i was to say write software and name it like other software. perhaps like Nero Cd Burning application instead of the normal name and some one not the owner of the file put it on the p2p apps and just watch the dls for it and see if its an bsa or riaa people dling it i wonder if you could sue based on the ip address and say well they dled it its being used without my consent.

You would not have a valid copyright on something named after someone else or someone's else's copyrighted work.
So calling your song file "Brittney Spears - Oops, I did it again" will not give you a copyright on that file, since the name interferes with someone elses copyright. |

Then keep pestering All the ISP's everyday to find out if the RIAA downloaded your songs or have them in a shared folder...Then sue them if they did. That would be a Hoot! But then again, they don't share, Do they? Oh well, just an idea! oops I think someone had the idea before me! Well,I second the motion! After the fact I mean the second time! What do you mean "pestering All the ISP's everyday to find out if the RIAA downloaded your songs or have them in a shared folder"? I thought the way it worked is you find out yourself who is downloading your songs, note the ISP/IP/date/time, then file a claim with the court to have the RIAA give you the name/address of the person who matches the IP information you have.
It was my understanding the ISP would not (and did not have to) actively search for anyone who traded copyrighted stuff - they just had to respond to subpoena requests. Did I miss something? |

It sounds silly for me to take that seriously, but I have read similar posts in other theads where people were dead serious. But, yeah, I certainly get your drift.  |
