Except you forgot something....
Article 1, Section 9, Clause 5: No Tax or Duty shall be laid on Articles exported from any State.

Don't you just hate it when that little something called "The Constitution" gets in the way of your pet

True but the Constitution has essentially been moot since 1933 when emergency powers were given to FDR and have continued to this day. Heck, New York State has a constitutional ban on gambling yet the Governor has been working overtime to get around it by teaming up with Native American tribes and taking a percentage of their income. When you get right down to it now, the Constitution is just a piece of paper that is probably more valuable for its status as an antique than the words that are written on it.

Not exactly. Gambling is normally done on the reservation, which is in effect either Federal property or a foreign country. Not sure exactly. And that means that NY has no legal authority there.
