I searched and the last topic was too old to reply too!!! In this instance only..... I have about 300 LP albums that I can no longer play. Is it piracy if I only download the song I legitmately bought 15 yrs ago? |

Not everybody shares this view. When you own an album (of whatever type), you've purchased a license to that music. Obtaining that same music - as long as there's still just one "user" - looks like as clear a case of "fair use" as I have ever seen.
It's only theft if you're taking music for which you have neither permission nor a license.

But he's not reproducing a copy. It's downloading a completely different copy.
Yes, I agree many people do not share the same view. I personally don't think it should be piracy, but to the Canadian Music Industry, it would probably be considered piracy. -- Mindless Self Indulgence |

But the Act does not place any limitations on your source . The only thing you are not legally suppose to do is lend / upload to someone else to copy it ... |

A few years ago I started converting some of my vinyl to CD...Some of the LPs were scratched up a bit...Software like CoolEdit or GoldWave allows you to remove some of the noise, but it was tedious... It was alot easier to borrow friends CDs and rip the songs or download from Kazaa, Napster or Limewire... |

| reply to anon1000 I do it all the time. Between my Dad's old eight tracks and records, I am slowly getting them and burning them on CD for him. That way the songs now sound better, and he has them archived on his computer to create his own mixes. -- I live in my own little world, but it's ok... they know me here |

What's the difference between downloading a copy of something you own and making a copy and cleaning up except saving yourself some time. |

That also means re-downloading the song from the internet, since you already have the rights to own and listen to that piece of music. It's similar to software, but a whole lot less complicated.
Even if you didn't own the music, it's not illegal to download any form of music from the internet. We pay a levy on blank recordable media and, as a result, the courts have declared that it's open season for us to do as we wish. The Copyright Board of Canada. They also consider downloading music as something legal.

| reply to anon1000 Actually the courts haven't ruled on anything. The downloading decision was a ruling made by the Copyright Board of Canada which is a federal government regulator. The recording industry still believes downloading is illegal and will probably challenge the ruling in the courts. So I don't think this issue is settled yet. -- One of the best movies of the year and by far the most entertaining. |
