its radsl

meaning its rate-addaptive. most dsl modems dont lock themselfs to a certain speed then can only have that speed no matter what. they usually (by powers of 2 often) lock themselfs to a certain upstream and downsteam speed to which they can obtain the strongest signal within their parameters. if you had gotten the 7000/768 package but you were too far or had too poor line quality to reach that speed your dsl modem would of continued to try to synchronize until it reached a speed it was satisfied with. if your home was only able to get the 1500/384 package because of distance, the modem would of figured that out for you and you would of only gotten about those speeds anyways. the fact that you are unable to connect during the day doesn't seem to be a speed factor, probably more dependent on your line quality and their equipment reliability.

Same problem with their billing

I'm having the same problem, and have billed every month since I've tried to cancel them. I've forwarded my negative review to them in hopes that'll help them cancel my account and quit trying to steal my money.

I'm going to be reporting them to anyone I can, and recommend you do the same.
