ISP Six Strikes Plan Still 'Coming Soon'
Entertainment Industry "Education" Campaign Looms

Last summer major ISPs including Comcast, AT&T, Verizon and Cablevision signed off on a new plan by the RIAA and MPAA taking aim at copyright infringers on their networks. According to the plan, after four warnings ISPs are to begin taking "mitigation measures," which range from throttling a user connection to filtering access to websites until users acknowledge receipt of "educational material." The plan, as with most plans of this type, was hashed out privately with the government's help -- but with no consumer or independent expert insight.

Click for full size
The EFF has already pointed out some serious problems with the plan, ranging from users only being able to use the "open hotspot excuse" once, to users having to shell out $35 to protest their innocence. It will also likely jack up the cost of broadband service further, as non-pirating users have to subsidize efforts that likely won't do much to impact piracy.

So where does the plan stand now? According to a report over at Ars Technica the plan's still still in the oven, the group that will spearhead the effort (the Center for Copyright Information) remains hard at work, and ISP users should start being "educated" very soon:
quote:
Curious if the consensus behind the deal was falling apart of proving harder to implement than expected, I spoke to several sources in the rightsholder and Internet communities; each agreed to speak off the record, as CCI has yet to make public announcements. Each confirmed that the project is pressing ahead and that it will in fact launch shortly. CCI has just hired an executive director, and the group plans a set of new announcements once the director is in place and up to speed.
Meanwhile ISPs like Verizon continue to send users letters at the entertainment industry behest, some going so far as to voluntarily insist that users will have their connections severed if the file transfers persist (in Verizon's case, we've found they're bluffing).

Hmmm...

If we count up all the attempts at trying to force back the clock to a time when the **AA's antiquated business models actually worked, aren't we way past six strikes!?

Oh wait, they meant it the OTHER way. Never mind...

This is - What? The 4th attempt in 4 weeks by Big Media to push through laws they bought?

November 6th is coming folks. At some point we may want to stop voting in legislators/executives who's 1st loyalty is to Big Media.

Except this effort has nothing to do with laws. The entertainment industry discovered that they can just go around Washington and deal with the ISPs directly.

That option has been on the table since the beginning.
Prob is; 95% of the ISPs have no interest in taking orders from Big Media.

After BM's demands are ignored by the ISPs, they go to their pre-paid legislators and have them codify those wishes into law.

They're one of the largest BM. Comcast could be in that 5%.

If they think this is gonna work and people will continue to pay them each month for crippled service, they got another thing coming. I'm looking at you Comcast! In case these people haven't noticed, we are in a deep recession now and people can't afford to keep spending money on entertainment. It must be nice to be rich and not have to worry about feeding yourself.

Exactly. When one needs to feed themselves and their family, entertainment is the first thing that gets cut back, especially when its quality gradually declines and accessibility and pricing do not improve. If MPAA/RIAA really want us to spend more money on their movies/music, here's a list of things they can try to do:

•Speak with our employers and convince them to give us bigger raises. As for those who are unemployed, get their ex-employers to bring their jobs back from overseas.
•Speak with our landlords and/or banks and convince them to lower rent or mortgage payments.
•Speak with utility companies and convince them to lower their bills.
•Speak with companies producing food, oil/gas as well as others that produce bare necessities and convince them to lower their prices.

Logically speaking, if we have more money left in our pockets, we might spend it on entertainment.

If you speed, forget to signal, roll thru a stop, fail to fix a burnt out brake light bulb, you deserve to lose your license. Right? Illegal is illegal, 66mph is not 65. We can easily install a device on your car to monitor all things that might be illegal, very easily.

Actually in every state a motor vehicle violations add points to your license and if you get enough points you WILL lose your license.

My home state of Louisiana doesn't have a point system.

Just FYI.

And once again how do you expect anyone to take you seriously when you clearly use a trade marked logo that you don't have permission to use?

Consider yourself lucky. Here in NY if you get 11 points in 18 months or less, you can kiss your DL goodbye for at least 6 months I think, after which you will have to re-apply and go through the whole process from scratch. In regards to points, you get 2 for speeding 0-10 over the limit, 4 for 11-20. Going 40 over the limit instantly gets you 11 and thus DL revocation on the spot. So does DWI, for obvious reasons.

The above is understandable though. Since cars can be dangerous weapons if operated improperly and can hurt or kill people instantly, the government considers driving a privilege, licenses people to drive and puts measures in place to take these privileges away from those who abuse them. I can't say that that illegal downloading causes as much physical harm as improper operation of motor vehicle does, and a similar system is not the answer.

In the city I used to live they forgot about the point business as long as you paid. You could accumulate as many speeding tickets and red light tickets as you liked. The only catch was you had to be caught by a camera, not a human officer. Incidently, the system was put to a vote and the cameras were removed.

Avatars have to be APPROVED by the mods on this site. I'm pretty sure they are knowledgeable about copyright law. Unless you are inplying the mods here are stupid. Is that what you are implying?

mods don't have the right to grant you use of copyrighted and trademarked logos of which they do not own.

Its just super funny you can't even adhere to your own position.

(No hypocrisy here BTW, as I don't share your feeling on copyrights, which you apparently don't take seriously yourself)

Let me color this in crayon for you. If you post a link to a illegal site that allows people to watch MLB game the mods will block it? Why? Because they don't want to get into any trouble. If my avatar was a copyright violation they would not approve it because they don't want MLB lawyers to be sending them letters. Get it? Now if you REALLY think my avatar is copyright violation please report it to the mods. Since they were the ones that approved it I assume they'll find your report amusing. I'm prety sure this site has some sort of legal representation that advises them to what they can or can not do or use on this site.

You really think they consult a team of lawyers each time someone submits an avatar?

Long story short, you are infringing upon copyrighted material (you can actually see the mark on the logo). Is MLB going to scour the net 24/7 to make sure everything's clear and paid for? Hell no. However, you can be guaranteed that if they made so much as a peep in DLR's direction regarding your avatar, it'd be summarily deleted right there and then to cover ass.

Seriously, this is like trying to argue that speeding is legal...so long as there aren't cops around to enforce the law.

BF69's ignorance is amazing. And Thaler is correct you can literally see the mark on the logo.

This is extremely funny.

His position is essentially that its no big deal if he does it, but when other people do it they should have their internet shut off.

Keep in mind, I'm being told to not download by companies that also told dead people, grannies minus computers, etc. to quit the downloading too.

I'm not saying every case is a false positive, but the entertainment industry's done a good job at getting me to not trust their information.

what about false positives? college professors with the same name as a band posting a class audio file have been flagged
the ISP getting the wrong IP?
very weak evidence?
open wifi (in places that offer free wifi?) even basic password that some places with free wifi does not stop it and I don't think all places with free wifi have security or lock down.
spam / hijacked websites that try to auto download files / auto install carp?
legal backups of software / music being flagged?

Useing this a weapon to shut down competition?

So does that mean if you speed more than twice, they should break your feet or hands? Speeding has more actual realistic consequences to it than 'copying' something.

Artist/Studio Compensation

Most likely if you are getting copyrighted content on the web and you're not paying for it (either download fees such as iTunes or subscription fees such as Netflix or Rhapsody), then it is most likely pirated.

My iTunes library has 100 percent legally acquired material, either through my CD collection from the pre-downloads era (90's and early 2000's) or the iTunes store. We also have many cassette tapes and vinyl records but it is cheaper and much less of a hassle to just download the songs on iTunes as ripping a record or a cassette is time consuming. My mother remembers 8-tracks, but we don't have any of those lying around.

I still buy CDs now and then as some artists (like Garth Brooks, Kid Rock, and Def Leopard) refuse to make their collections available on iTunes or any other digital music service. It mostly has to do with the artist compensation from Apple (although many of the above mentioned Artists are not available on Rhapsody either).

A good free and legal source of Copyrighted material is your local public library. You check out a CD, DVD, or VHS tape for two weeks on average (depends on local library's loan period, which varies by jurisdiction) and return it by the due date or face fines (which vary by jurisdiction). Just don't make copies of library materials as that is also piracy. If your local library does not have a particular title, just ask the librarian as they may be able to get it by interlibrary loan from another library. Here in Mass (I am in Western Mass), we can request materials from any library in Central and Western Mass.

WPS

With the recent WPS hack for WiFi networks that's extremely trivial to do, this is going to get nasty.

Unsuspecting people will be changing their WiFi passwords in response to infringement notices, but will still get hacked again and again, unless the individual knows about the WPS exploit and turns it off on his router....

Point is even with "secure" WiFi using WPA2, a lot of people are going to get accused of infringing copyright when somebody else used their connection.

How about ..
