Six Strikes Official Says Nothing Happens After Sixth Strike
Though Previous Language Suggests Possible Lawsuits
Earlier this week leaked AT&T training documents indicated that most major ISPs would be launching the entertainment industry's "six strikes" anti-piracy effort on November 28, but the organization tasked with enforcing the new system insists that date is not "set in stone." Speaking to The Hill, the Center for Copyright Information's (CCI) Jill Lesser commented on the leaked documents, noting that the launch date of the program could still be fluid:
quote:

"There are [implementation] dates in draft materials that are not set in stone and we don't want to create any expectations we can't meet, but we're really close and we'll start seeing alerts over the next several weeks," said Jill Lesser, the executive director of the Center for Copyright Information (CCI).
The program has seen significant criticism for assuming guilt, requiring that accused pirates pay $35 to contest their innocence, relying on often-unsound IP address evidence, while potentially driving up the costs for all broadband users as ISPs pass on program deployment costs to consumers. Each ISP's program will be slightly different, but Lesser indicates no ISPs will sever user connections. However, at least one ISP will throttle user connections, and some will implement walled gardens to lock users down until they read "educational" material:
quote:
"In one case there's a temporary slow down of [Internet] speed, but that doesn't impact access to sites," Lesser said. "That's not the way this works at all." "When you're in a walled garden, all you essentially have to do is go through the education [material] and then you're out of the walled garden" she said.
Lesser also suggests that "nothing happens" after you reach the maximum six strikes:
quote:
"If you continue to engage in copyright infringement, you're not going to continue to get alerts," she said. "In our mind, we're going to target consumers that respond to these alerts. The alerts stop after that last level and nothing else happens under the program."
That may not be the case. The language of the agreement between ISPs and the entertainment industry suggests that the data collected during these warning processes may be used to file lawsuits against potential users. Proxy and VPN service providers say they have seen an uptick in subscriptions as users who consume pirated content employ measures to hide their BitTorrent habits from the prying eyes of ISPs and the entertainment industry.

So then it stops?

Does this mean that they are only going to annoy me 6 times then I can download without further warning? I say we bump it back down to 3 strikes.

Mediacom has a 3 strikes policy instead of 6 strikes. But they also cut you off for life after the 3rd strike.

Tobacco company execs at least have (a very little bit of) compassion. Still several orders more than cable execs.

Smokers die, Copyright infringers should only get sued. I dont think jailtime is necessary.

The ISP stops annoying you. Then the RIAA & MPAA starts suing you with all the info they now have on you from the ISP.

if you make it to the 6th strike you really suck at pirating stuff.

Yea, Im breaking laws all the time, howd you guess. Any laws I break are accidental. eg, possibly speeding. I never willfully break the law like these people (you) do. Knowing something is wrong, and doing it anyway, is bullshit.

If you are speeding, you're willfully breaking the law. There is no "accidental".

I have spoken with not only police officers on this but lawyers and judges as well. It falls under the category of "your fault" as ignorance of the law is not a qualified defence.

Yes your state has a law that says if you don't see a sign then they have a set speed limit you should be going under unsigned roadways. You didn't follow it, you broke the law.

When did I say I would not be breaking the law?, I said it was ACCIDENTAL. Do you browse the web and accidently download 500 songs and movies?

Stop putting a spin on one sentence, and try to read the entire conversation.

Re: Not defending 6 strike policy, but

There is nothing accidental about going over the speed limit. It's either you did or didn't. How would that be accidental? You weren't paying attention? Your fault for not paying attention when the law requires you to do so.

Dude, reread the exchange involving other people. Someone accused me of breaking the Law ALL THE TIME. I said if I do, its ACCIDENTAL, as in, NOT PURPOSEFULLY DONE.

Are we on the same page now?

For someone to download illegal copies of music and movies, its done purposefully, not accidental.

Re: Not defending 6 strike policy, but

Dude, someone speeding is not ACCIDENTAL it is done PURPOSEFULLY. Again, care to explain how speeding is ACCIDENTAL? It isn't... even if you do it.

This is the argument that you made. Just because it's totally flawed it still doesn't make it correct.

The ONLY person that mentioned copyright infringement was done ACCIDENTAL or PURPOSEFULLY... was YOU! Do you see anyone besides you mentioning that? Apparently I was paying attention however... you were not!

Already covered that awhile ago kiddo. Yet you accuse others of not reading the thread when your not even reading your own posting? Seems I have more brain cells than you. Here is where it was covered:

That also falls under "your fault" if your not paying attention to signage. You were PURPOSEFULLY not paying attention when the law requires you to do so.

doesnt matter if its an accident or not, you still broke the law. start trying to apply the same rules to yourself. its really easy to tell people not to break the law and not apply it to yourself.

Good time to switch

If you have a independent isp in your area now would be a good time to switch. ISP's shouldn't be in the business of monitor their customers traffic no matter what the reason. curbing the size of traffic is another matter. Content shouldn't be messed with, at all.

How about ..
