It's illegal distribution of copyrighted materials. If I download a copy of "Spiderman 2" via a P2P network, I'm doing something illegal, but it's hard to track me and not very cost-effective to prosecute me. If, however, I'm sharing a copy of "Spiderman 2" (along with 1,000+ other titles) on a P2P network, it is very easy to spot me and easy to prosecute me.
I do think that the RIAA has abused their ability to prosecute the uploaders (by forcing them into one-sided settlements and not allowing them real due process which might weed out mistakes), and I think that the penalties are too severe, but in general I agree with their approach. FYI it's not the RIAA or the MPAA...if the artists want to give away their rights to the product, they freely can...the RIAA and MPAA is the buffer between the artists and the fans...and the RIAA and MPAA work at the request of the artists.

Some artists don't write their own music, thus either the original songwriter or the label (especially if the songwriter is a work for hire) owns the copyright.
The situation is different with every artist. With the possible exception of pop stars. Who most of the time don't write their own music, which means they have nothing to own in the first place. | |

The usual record contract (with the major labels), if I remember correctly, requires all rights to music and production, as well as a fixed number of albums and tours. Most of the artists who own their own copyrights completed their obligations under their original contract and bartered a better deal on their next one. | |

More and more artists are producing their own works and most of the unsigned ones won't even be looked at unless they have practically a finished product in their hands. That gives the artist a little more leeway if they play their cards right.
Also you now have the Internet, which can be a major promotional tool for unsigned artists. A major record label will likely start offering more favorable contracts with those artists who create a strong buzz before signed. It's better to get an artist signed with you and make a little money than hold out for more money and end up having the artist sign with someone else. | |

The main contention by the RIAA in terms of filesharing has less to do with publishing rights (who wrote the song) than it does to do with performance rights (which in the majority of cases is owned by the label--unless they're only acting as a distributor). For example, Donald Roeser wrote "(Don't Fear) The Reaper" but Sony owns the recording everyone's familiar with so therefore Donald Roeser can't give copies away (even though he owns the compositional rights). He CAN record a new version and give that away, provided his recording of a new version doesn't violate his contract with Sony. All compositions carry one copyright (the "C" in a circle) and all recordings of compositions carry a different copyright that protects the actual performance (the "P" in a circle). Thus, a CD is covered by two copyrights. | |

Now, I admit I have downloaded a couple of movies that were still in theaters (both Spidermans and Dawn of the Dead)...but, in my defense, that was after I had already seen it on the big screen (more than once for the first Spiderman), and I also shelled out the $20-something for the DVDs when they came out.
I still think that the MPAA has less to lose than the RIAA when it comes to people sharing files. To me, there's no substitute for the big screen experience. | Long overdue They should have started filing these lawsuits five years ago. They foolishly delayed, thinking they could strike a death blow to file-sharing by lobbying for new laws against it. In the meantime the mindset of the public has changed quite a bit. A few thousand lawsuits back in 2000 would have had a big impact. Now it's going to take tens of thousands.

| Re: Long overdue I agree. The RIAA sat on their asses for too long while Napster took off and everyone and their mother thought that it was OK and legal to download music from it. Then when the Napster lawsuit started, people were somewhat shocked and upset about it. But the damage was already done. People were used to free music in an "all you can eat" environment. So of course when other P2P solutions came out, people flocked to them. Once again, the RIAA sat on their collective asses for too long before starting to go after people.
Now the MPAA had a chance to nip this early because moving a movie over the net is a much bigger deal (time and space wise) then a song. It wasn't happening as much because people just didn't have the bandwidth to do it efficiently. But times are changing and movies are being moved around all over the place now.

Anyway....Attached (hopefully, if not I'll post a link later) are some attachments that may tell us a couple of things about the influence of media corps. going forward.
1. Arlen Specter has been properly lubed and will the MP-RIAA's new Republican pivot man in the circle jerk that is the judiciary committee. WHY you ask? Because he will be the new chair in 2005 replacing good old Orrin Hatch.(what the hell is it with these names? Orrin? Arlen? Damn...these people had parents that hated them).
2. BUT...they have bet the mortgage on the wrong horse and if I'm aware of this you'd better DAMN SIGHT believe that those Repubs more firmly in control of Congress and the White House are VERY aware of it, having had to fight against that money in recent elections. Check out the disparity in donation amounts and party affiliation of recipients. DAMN. The money they gave to Repubs. is the equivalent of a dozen roses bought for your wife after she found out you took your girlfriend on a "business" trip to Bermuda. If anything it will only make them angrier. And of the top 20 senate recipients only 2, yes 2, were Repubs.
When you go "all in" like this you can either win big or lose horribly. They lost horribly. Knowing they were now facing darker days in the legislature, it seems to me that the MPAA is trying to make some of that "suing evil pirates" hay before the political winds change direction and bring the rain. I'd say the copyright/patent/IP scope enlargement and protection creation is currently one tick PAST it's apex and will be waning for some time to come.
3. That Orrin Hatch, while stepping down as judiciary committee chair, is STILL and major wanker, hence the Orrin and Barry Manilow picture. (I can't get enough of that one). -- Don't suspect your friends...Report Them.

This is very bad PR for the MPAA, and I will tell you something; I don't download movies, I like to buy them and have access to all the extra "frills" on the DVD, and then sell them back to the store when I am finished (It usually costs less than a rental to buy/sell-back). HOWEVER, if the MPAA becomes a fascist-litigator like the RIAA, I will just for spite waste my bandwidth and start downloading, they will loose a paying customer, as the RIAA has!

| can we do anything online anymore legally? OK here's how I look at this whole downloading content for free thing. As far as I'm concerned, you're not downloading the content for free at all! I mean the last time I checked I was paying $73.25 including taxes for a 3Mb/sec down and 768KB/sec up connection to the internet by way of ADSL. So it seems I'm paying for a connection where using it to share content is illegal, which in my book is really sick! If it's illegal for me to transfer digital content to another computer, then I ask, what the hell am I paying for such a good internet service package for! It's as if any of the basic things one can do on the internet such as sending data from your computer to another computer is a crime now. If I pay for the access to the network, shouldn't I then be able to make use of the bandwidth I'm paying for in any way I wish, within reason of course? Now don't get me wrong I'm not saying I wouldn't mind paying for the ability to download movies or music. In fact I wouldn't mind paying for those at all if they'd get rid of this DRM crap that they insist has to be on every file they put out currently! Those that subscribe to premium usenet news servers such as myself don't mind paying the $10 per month for that privillege. Why is this? Because I can download the content free of stupid digital restrictions and therefore play it on any of my 3 computers, one of which is a linux machine. Now with this in mind if the RIAA/MPAA were to have several servers connected directly to say an OC48 line to the internet which you know they could aford easily, and offer a service that worked like news providers in that you pay for access to their servers and you get to download anything and everything that's ever been out or that will come out in the future in any audio/video format you chose and at any bitrate/sampling rate you wish, then I'll bet folks would have no problem paying, as they'd always max out their internet connections, even full DS3 connections! Now yes that content would still appear on peer to peer networks, however with that type of system in place, folks would flock to the RIAA/MPAA services to download their favorite music/movies, since it would pretty much max the end users internet link. Why haven't these folks even thought to try this idea, instead making us look like criminals as bad as murderers, and making us download crappy DRM files that can only be played on the computer you put them on? If I download a file, no matter what the file is, I'd better be able to send it to any computer or device I wish! Has anyone even mentioned this idea to them? They'd get tons of money, and we'd get our favorite content, it'd be a win win situation! Why is this so hard for the folks at the RIAA/MPAA to grasp this concept. If that's how they are, why not make it so you have to buy content from them that only plays on the brand of player you have! God it's sick! Let's expand technology, not make it illegal to make use of it! | |

| A few questions If memory serves me right back in the day when vcr's first came around didn't Sony try and sue over this and a that is when the home recording act came about? saying that a portion of all sales is set aside to pay for digital recordings of materials.Wording may not be correct but something to this effect. I am not saying that downloading is legal 100% but is there much difference in borrowing music cd's and dubbing them with your double cassette players or renting or borrowing a movie and recording it. What about the ability to record tv shows straight to dvdr now. I know that no one has been sued for downloading and it is all about the up loaders.I have felt for years the way all these organizations are going about this is wrong.If you want to stop or at least slow down this so called epidemic go after the release groups, yes they pop up as soon as another is shut down but has anyone seen news about a release group being busted and given time?Kinda the same way them spam issue needs to be addressed at the source stop the money you will stop the spam,make it illegal for companies to pay spammers and they will spend that advertising money elsewhere and the spam will stop. | Give the people what they want Instead of doing this sh*t just start giving the people what they want mpeg4 encode movies that take less then 30mins to download if u receiving at least 120kb at resolutions of 420x240. People dont want to have to get off there ass and go rent movies or go buy them at a store waiting in lines and I know a lot of people prefer to watch a movie at home on there plasma TV's and surrounds sound systems they have spent a huge amount of money on. lets see most movies cost about $10 take away the producing cost meaning material that movies are shipped in should lower it like 2 dollars. Shot im pretty sure that people wont mind using there bandwidth to get a movie like using bit torrent legally. And dont get me started about music a song is worthless all they are for is to advertise the band or group so they can get gigs but the thing is that they are becoming lazy expecting to receive a Huge amount for something little. If they want more money sing at a concert do you see bands that go play at weddings etc they usually receive 3g+ for small gigs. Im sure that famous artist's could get a great deal more for performing. The thing that they are not getting is this is the same shit that has been going on for centuries people that are supplying entertainment want to receive Huge amounts of money for something that is getting easier to do lets see people though records where a God send because they didn't need to pay that much to go listen to someone sing and could just sit down with friends and have a wonderful time. Tapes new technology that replaced records and where looked badly by the music industry because no more business for them but the cut production cost by a great amount and made easier to get. CD/DVD can I say anything about these that is different from tapes. Internet the best thing EVER Entertainment/Ebay/Shopping/News/+. America is Lazy and you know it now stop abusing the dumb and the youth we made them that way.

| Wrong. The majority of the people who download copyrighted material DO pay for it anyway. If they didn't you would see massive drops in CD sales, DVD purchases, rentals and box office draw. That's not happening. As a matter of fact more sales records are being made now than before P2P.
