Telling iDownload off in legalese
(old news - 06:53PM Tuesday Mar 01 2005)
tags: legal · spyware
As we've mentioned at length, several websites have been sent cease and desist letters by the makers of iDownload & iSearch, warning those sites to stop calling the products "spyware" or face legal action. Sunbelt Software also received the threat, and posts their response for public review. Those interested in reading more should check out this story and this forum thread.

Nice

"...As a result of Sunbelt’s re‑examination of the iSearch applications, Sunbelt has determined that, in light of its targeting criteria, Sunbelt will not be changing the status of iSearch at this time. However, Sunbelt welcomes an open dialog and would be more than happy to review its current listing threat levels or default actions (quarantine, remove, ignore) should iSearch demonstratively show a change in its practices...."

CounterSpy counterstikes

That in itself is reason to give CounterSpy a trial run.
"...we sent a response. It's 16 pages, with detailed documentation about iDownload's practices"
I'm sure it was a lot clearer than a 45 page EULA.

I wonder who helped them write such a long response?

Kiss off...

...iDownload/iSearch. You know your creating spyware/malware. Using deceptive methods to propagate your software on to users machines. And some how you want us to all just turn our heads and accept that your software is legit. Urrrr.. wrong answer..

You do know their product is basically a licensed version of Giant, right? (Which is a good thing.)

Re: 3 Cheers for Sunbelt!

I'm using a trial version and it found minibug software in some registry keys that were not even there.

Re: Sunbelt is wicked

Yes they will actually, check out there site, they have there own team, they are the most comprehensive anti spyware software on the market and they are recieving the microsoft updates on top of there own sources, they will be around long after the rest of them quit working as they are not only the most popular paid spyware company but they are now recommended, sold and supported by Dell.

They are currently updated with microsoft till 2007, they are and will continue to be updated by their own team and the threatnet community. Honestly, try it out and you will see they arent going anywhere

StraightShoot, you're right on many things, but on this one, I think you may have been given incorrect information.

We fully own this code. It is not some "licensed" version of the Microsoft product. We are innovating on it at a rapid pace with our own team.

CounterSpy is actively being developed by a world-class team of developers here at Sunbelt. Our research team is also adding definitions to what Microsoft sends us. With CounterSpy, you get two layers of definitions: Microsoft's and then ours.

As the Microsoft statement says, we get their definitions until July of 2007. But we're already adding our own.

We're pleased CounterSpy did well in the new PC World shootout »www.pcworld.com/reviews/article/···2,00.asp and the enterprise version was just reviewed quite favorably in eWeek »www.eweek.com/article2/0,1759,1764149,00.asp

Open it with IE. ^_^

I've converted it to an HTML file, but due to possible legal reasons, I can't upload it.

As much as I'd like to, as it is a very good read, I want to respect Sunbelt ^_^ Maybe ask them to post it as an HTML file.

Sorry about that, the MHT file was a result of moving too fast this morning. I will get a PDF file up tomorrow morning when I'm back in the office. Check back.

Awesome Response!

I can't believe they would argue that it isn't spyware/adware! IMO, it's a crime... and they, in turn, should be put in the slammer to rot for life.

Read this:

In this link, about 15 posts down, Arlo says "our p2p and voip apps will be going live very shortly". That will be interesting when this fine, fine company (I can't afford an attorney) begins offering P2P and VOIP services.

This link was publicly posted by Arlo's ad manager, "Wiseman" who's real name is Ryan:

Click on the "wedding" link, then look on the left side, 3 pics down and you'll see a pic of Arlo and Ryan (Wiseman) together at the wedding. Awww. Aren't they cute!

Google is a wonderful tool for obtaining info about fine upstanding people in who's shoes we'd all love to be in and who, despite hard work and effort to do good and spread love, cheer, and happiness in the world, are severely misunderstood and wrongly maligned. Why, I'd never say anything derogatory about such fine people as we know work at idownload.com! Also, did you know that their attorneys are also wonderful, cheerful, God-fearing folk? They take in orphans and such. Read the Good Book every evening they do. Fine members of the community all of them and a shining example for us all. If only I had the money to afford attorneys like that. Land sakes, some people (fine upstanding folk) have all the luck.

Sunbelt

After spending 6 hours getting iSearch off my wife's computer, there is no doubt that it is not only Scumware, it is highly predatory, not dissimilar to sexual predators and should be viewed at about that moral level.

Cheers to Sunbelt. I highly recommend reading their response to iSearch's legal threat. It is highly literate, concise and specific. On the other hand, iSearch's attorney wrote a generalized blustering huff-and-puff letter that basically said nothing at all beyond vague threats.

I downloaded CounterSpy which is the only software that detected all of the junk and even then it took 4 scans to get rid of it all.

I have a feeling that the morons from iSearch, iSlime or whatever they are called don't really know who they are messing with.
