iDownload has responded to both Castle Cops and Sunbelt Software's refusal to characterize their software as anything other than spyware (which it is, since it has been proven to use unethical installation techniques).
"Thank you for your recent correspondence regarding iDownload and its software product, iSearch. As we are both aware, a lively internet debate currently exists over the functionality of the iSearch program, as well as the questionable classification of iSearch as malware, spyware, etc., by various security companies. As counsel for iDownload, our goal is singular in purpose, that being to assist iDownload in correcting the current dissemination of incorrect information surrounding iSearch.

We recognize that much scrutiny exists with respect to our actions, and that we may be perceived by some in the internet community as being on the wrong side of the ongoing fight against "internet malfeasance." This perception is contrary to reality. We are currently engaged in an open dialogue with several large security firms, with the end goal being to reach a consensus as to the proper characterization of iSearch. We trust that you will conform your published materials, as we previously requested, once some of the industry leaders analyze iSearch more thoroughly and release their classification of iSearch."
Outrage is redefined as "scrutiny", legal threats are redefined as "open dialogue", and shutting up critics is redefined as "correcting the current dissemination of incorrect information."

If you recall, cease and desist letters were sent to a number of security websites and developers, informing them they could no longer call the iDownload and iSearch applications spyware, malware, or foistware.

If you can't uninstall it....

It's Malware/spyware. If it's legitimately installed, and easy to uninstall, then I'm more at ease with it. All I know is it took me hours to get rid of iSearch on someone's computer, because I had to find some no-descrpt .exe that kept re-installing it whenever SpyBot killed it.

I agree, it is spyware (Aka crapware). Now is someone going to sue me because I agree, and I call it that? If they do I hope for their sake I can't find them. Suing anyone is not going to prove who is right or wrong, just who has more money.

Ok, how about we (as a group) go at it like this since we know who the company is; where they are; and what they are doing.

(I'm not in the legal profession, so please don't consture this as being an action you should take. I'm hoping some of the folks involved in the legal profession will step in and claify what might be achievable.)

Every time we get this software from Idownload installed (unwantedly) on our systems we file suit in small claims court asking for 2 x your hourly wages for the amount of time it took to get out of your system.

The reason for filing in small claims court; simple; in the majority of the states within the United States; the actual defendant must appear and can not be represented by legal represneation.

In most cases; (as I understand it) small claims law is generally used to force the defendant to provide restution or otherwise make whole the petitioner(s) property to what it was prior to the offence.

Considering; there is likely we would all site as the person to be served the court summons; it stands to reason he'd have a hard time being in all the required locations at the same time; hence; the person beng summoned would loose the majority of the cases because the defendant did not show up to the mandantory appear.

Now; trying to get the money from the company / person / may prove to be difficult; but that's another story.

Yes and No, some of that are good idea's. Like dragging them to small claims court. As far as legal representation, when I went to court against my former employer, nothing I saw denied me the right to untilize a lawyers services.

Also as far as the timing goes, most courts will reschedule if they have to be in court in another district, county, state. You will have court cases lined up between here and eternety. Also if you fail, they can counter file for lost time and wages having to come fight you.

Since the lawyers do not like the term spyware or malware, might I suggest that we start to use the word 'Crapware" to describe their product. Do the crap eating attornys have any basis of a lawsuit then ?

From their obvious toning down of their rhetoric in those replies, they appear to understand that there was never a basis for a lawsuit and hoped that the nastygrams would scare the bloggers into shutting up.

For those two quite the opposite and now that people see that iDownload's sharks are toothless wusses hopefully more will stand by their assertions and not buckle like PC Pitstop did.

The writeup does a good job of translating the lawyer-speak, but you missed one:

Translation: We are trying to pay off some anti-spyware vendors so that they won't include iDownload and iSearch in their spyware/malware definitions.

They are now asking for donations to help encourage the development of bad-ware.

Suzi on Spywarewarriors called this outrageous ....for a man who is allegedly a multi-millionaire primarily my foistering bad-ware on the una-ware.

What I don't understand

Is why M$ or for that matter even Dell or the other major OEM don't go after these guys. As far as any reasonable person is concerned, this crapware does nothing good other than muck a persons PC up casuing a less than desireable computing experience which in turn causes M$ and the OEM's money in terms of support calls.
