Battles North Kansas City fiber plan
(old news - 12:56PM Thursday Apr 07 2005)
tags: legal · Fiber · municipal
As we previously reported, Time Warner Cable took the city of North Kansas City to court to stop it from wiring itself with fiber (funded by local casino revenues). The Kansas City Star reports Time Warner's case has been thrown out. Time Warner argued that state laws require a vote for such plans; the law however only applies to cable service (not fiber). The city has yet to decide if they'll offer cable service.

Isn't cable different than telco POTS?

And so is fiber.

You want to argue semantics, you will eventually get bit.

Way to go!

Yay!:) Sort of I guess. Kansas City and suburbs has had high speed for years but it has been SBC or TWC mainly with a few over build companies in certain areas. Now if my city could stand up to SBC and Comcast and get something going now that they have local courts showing support for the city and not the companies the incumbents might show some interest in the areas around KC that have only one choice in providers. (the scowl and glare goes to SBC, who for some reason can get DSL to people all around me, but where I am at now is unable to get DSL)

Hmm

If they actually put some actual use into the fiber, I'd consider moving to the Northside of the metro.

Re: Hmm

Its not the northside of the metro, it literally is North Kansas City. Only about 1400 households. KC north is completely different and you are back to SBC or TW or nobody.

That will show you the scope of the network. Now if the network was going to be built in all around the area that would be a different story. And I highly doubt that KCMO would ever commit to a new network, unless the people voted it in. And then getting all the little suburbs both in MO and KS, as I will posit now, is impossible.

Cool.

Finally a case where both sides run the entire race and it's decided in court where it should be, instead of in the media and/or by pundits with their own hidden agendas. Congratulations, KCMO for getting in there and getting dirty.

Now those casinos can bring video poker, blackjack, and all sorts of public services to those unable to visit their facilities.

Seriously, the only way this stuff is ever going to be worked out is for those involved to stop hurling turds at each other across the fence and actually litigate the cases. The FCC, et. al. are impotent.

Fat lady is just gettin tuned up

"A public vote must be held prior to offering cable television services, but unless and until the city offers cable television services without holding a vote, there is nothing for the court to enjoin," U.S. District Judge Ortrie Smith wrote Monday in his dismissal order."

This looks like a case of premature 'jaculation on TW's part because as soon as the muni offers tv, TW will be back in court and win.

Re: Fat lady is just gettin tuned up

They will win a chance at a vote. And if enough people get behind it they will lose.

However TW controlls the media and thus peoples minds. People are more stupid than we can imagine.

Re: Fat lady is just gettin tuned up

People suddenly become "sheeple" when it comes to muni broadband battles it seems. The more Telco and Bell ads thrown at them saying muni broadband is BAAAAAAAAAAAAD and can't be done by the unintelligent muni, the more the "sheeple" agree when it comes up for a vote...even if it means they could have an all FTTH/FTTB infrastructure providing the triple play with lower prices.

Ah, the power of advertising....and the ability of the deep pockets to pay for it.

Cool

To often I find the "system" being abused or not working as it was meant too. This is one of those very few rare times that is has.

Best of luck to the city of North Kansas

Lost in court, probably will win in Legislature

Telcos and Cablecos are going to state/US legislatures to ban such municipal activities.

Unless there is a change of heart in Texas Senate, Texas will join the pack of banning states since SBC is pretty active in lobbying the state legislature (i.e. contributing to their re-election funds and other PACs) to ban the municipal Wi-Fi and other broadband efforts.

Programming cost

The city won't over cable services. The programming cost and equipment cost could never be justified by 1400 households.

Insider123

Re: Programming cost

Actually, It only will cost any muni about 60K for a HITS system from Direct TV. HITS is a Head in the Sky system from Direct TV so anyone and download same programing offer by Direct TV and you can then add your own line up for VOD and other programing. I believe DISH is offer something for 15K and they will charge a base starting at a take rate of 500 subscribers. C C it's not rocket science. The High Def now is a bear because it consumes so much Bandwidth or you can compress the heck out of it so the picture quality suffers.
