Wireless carrier bandwidth crackdowns and app restrictions

For a long time we've been discussing the restrictions placed on third-gen wireless services. Verizon has sent warning letters to customers who use too much of their "unlimited" bandwidth. The Verizon Wireless terms of service essentially prohibits everything but web browsing. Members of Dave Farber's IP mailing list discuss a subscription Wall Street Journal report this morning on how unlimited - isn't. Of course these companies are even less happy about the flood of new 3G-to-Wi-Fi routers hitting the market. Sprint & Verizon charge $80 a month for "unlimited" broadband, or $60 if you subscribe to voice service.

Agreed.

Since VZW's TOS states that connecting to corporate Intranets are OK, I wonder if I set up VPN to my home (or work), and used the connection that way for VoIP/video, etc.

Verizon wont care if its a vpn. They can't sniff ur connection to see what the traffic is (well VZ Accounts Investigation can't, nothing stops them from reworking the system). They use a mbyte cap or top 5% usage to identify users to target. I dont think a vpn will matter. I guess u can try doing it then arguing and see what happens.

The problem is "sole discretion" clauses which permit them to further avoid contracts by defining up to mean down, left to mean right, and applying those definitions in one case only.

Imagine entering a contract where you promised to give all your labor and property to an individual where the person you were contracting with had the sole discretion to decide what terms of the contract would mean. Oh, that term $100,000 I promised to pay you doesn't refer to "dollars, it refers to pesos," but that clause five lines down which says you will pay me $50,000, that means "dollars." These contracts are heads they win, tails they lose. I particularly love the part about how they can change the terms and you can't leave. The rules of contract interpretation just don't seem to apply.

You know those arbitration clauses on the bottom of these contacts that we sign. I bet you that they even deny the aribitrator the right to revisit their interpretation of the meanings of these terms.

Oddly enough Sprint is going in the complete opposite direction ensuring customers that streaming video and gaming is perfectly fine with thier service. They also announced an evdo to wifi router in conjuction with LynkSys to be released the second half of this year. Talk about extreme differences in the adoption of new services.

The test will be when this technology is widely accepted at to whether it will be too much load on the towers.

I noticed this as well when researching wireless internet access this past weekend. Sprint actually wants you to use the network.

Verizon on the other hand - doesn't. If you use video or audio streaming of _any_ kind (even over VPN) they'll can you for it. And quickly, too.

Which sucks. Because Sprint, Verizon and Alltel are the only three offering EV-DO(nt) around here. AT&T/Cingular are still on the old system at around 300kbps.

I think I'll wait a little longer before I get this & cell service.

EDIT: It can be argued that the point of that is not so much about your battery, but to inhibit streaming from soaking up bandwidth. Also, unless they changed it in the last few days, they compress images so that they look awful.

When we got our card the rep told me that they could impose restrictions "at any time" to "protect our network bandwidth from hogging."

I have a fistfull of dollars waiting for EVDO. I thought that something might come out of Sprint now that they are advertising the service.

It is time for the affected users to join forces and sue them for false advertising. Unlimited HAS TO BE UNLIMITED... and if they are going to limit the use it has to be splicit. The crap in 8 font in the TOS needs to be terminated.

From the letter:
"It cannot be used with any machine-to-machine applications"

I'm pretty sure all applications are machine to machine unless there are humans with RJ45 jacks built-in that can also speak IP fluently.

Caps suck - they should be sued and forced to remove "Unlimited" from the service name.

What about Sprint,we need network neutrality

Sprint doesn't seem to do that though, I read somewhere online that a person used 4gb because he was sharing his ev-do card with multiple computers.

Sprint's Terms of Service(TOS) aren't as restricitve as Verizon it seems. I think the title should be "Enjoy Verizon Ev-do,but not too much".

NETWORK NEUTRAILITY- this is a great point about Ev-do becuase the telcos- DO impair and blaOk access to certain websites, but I am sure they wouldn't do that for their own content!, Mind you Cingular and Verizon.

If we have a network neutrality bill it may cut that behavior of cutting of subscibers who pay Top dollar($80 plus taxes and surchages are a lot) for internet access.

Although I don't have ev-do I am hoping on getting it later this year about revision A comes in a smart phone such as the ppc-6700 which can be bough on ebay for under $200 and with activation fee waived. The reason I won
t get is because of the 2 year contract. If ev-do revision A comes out then I wouldn't mind getting a smartphone that I could use on my laptop becuase I would be much less concerned about singing a 2 year contract. Why sign a 2 year contract when ev-doa is coming out,

Very naughty

Verizon should know better. We all know the shit the cableco's took for their caps on isp service. If you are going to cap, put it in writing. If not, get off people's backs. Sprint, clearly, understands the way of things and is offering the right kind of service. Think it's time to switch.

No streaming limits on Sprint

I've streamed XM radio @ 64K for hours and hours on my PPC-6700. No issues, apart from an occasional interruption while the buffer refills. I haven't tied video.

Sprint's data network is great. The only downside is no data when roaming. Exchange Activesync works when roaming occassionally but is blocked most of the time. The EVDO network is in virtually every city over 100K pop.
