Wiretap Ruling A Threat to Telcos?
Class action lawsuit expands after ruling
Yesterday's ruling by a federal Judge that the Bush administration's wireless wiretap program is unconstitutional could put the telcos that have cooperating on tenuous legal footing, reports Business Week. Meanwhile CNN reports that BellSouth & AT&T have been added to a class action lawsuit against Verizon by lawyers who believe their chances at victory have been bolstered by yesterday's decision.

Re: Bush

It all depends on whether the Judge's ruling stands on appeal.

All in the meantime is speculation, nothing more.

If enough people push the class action suit, the judges on the wiretapping case may listen.

Why? Either it's legal or not. Judges are apolitical right? (Meaning that supposedly they aren't ruling to please the crowd.)

Is it just me or do you find it funny that the telcos are getting there way, and when the PEOPLE ask for answers we are told Defense of the USA.
It sure appears that the gov. bought the telcos with any deal they wanted,if this is so then it would imply that the gov. did not have the right so they Bribed the telcos.

I think the bribe was for the FCC to role over and play dead when it comes to telecom matters. Although the FCC seemed to want to do that anyway, so I'm not sure there's a quid pro quo.

No Threat At All

No large company fears a class action lawsuit anymore. These always become the standard "bribe the lawyers for a few million and hand the victims $5 discount coupons for new service they haven't purchased yet." Some of these evolve into mechanisms for generating new revenue.

Case in point, a class action lawsuit against GM which had resulted in the victims of defective GM trucks receiving coupons worth $1000 towards a discount for another GM vehicle. Well, in order to receive the reward, the victim would have to further enrich GM.

If this ruling is upheld on appeal and the companies involved face criminal charges, then the shareholders and executives should be worried.

This will be awhile

Class actions can be withdrawn just as fast as they are filed.

We always hear the press release on the filings, you never hear about the withdrawals.

This one will be going for quite a while, so while the lawyers line up with dollars in their eyes, it may be years before it all sorts out.

My prediction?

Next president will ask Justice to work with the Senate and House Intelligence Committee on new legislation that will clarify the language. Once it passes Congress, Justice will settle the cases.

Political Hack

This bogus decision well be over turned in short order. The ACLU lawyer Jameel Jaf who argued the case before her is himself a fund raiser and apologist for various Islamic terrorist organizations. Is there any wonder why he would want to stop the NSA he is one of the people the NSA would listen to.

Judge Anna Diggs Taylor is a Jimmy Carter appointee who was given her judicial seat as an award for her help in getting Carter elected. She is not well thought of by her fellow judges on the 5th circuit. Read below for more information

The only people who win in a class action

are the class action attorneys.

This is news?

We'll all be lucky to get a $10 gift card good for more useless add-on services we don't want.

At this point I'd be happy if they were ordered to stop (for real and no fvsking appeals), barred from doing it again and all responsible went to jail for > 10-20 years. I don't care about rewards, I want it to stop and never happen again. If a class action suit can do that much I don't really care how much lawyers will reap.

I keep telling you: There IS NO JAIL in such cases. Therefore, in the end, it's all meaningless to the corporations.

Especially since they allready have legions of shysters on their payroll so the dont even have to pay extra for shysters.

Class action suits are meaningless. The only ones who make any money are the lawyers for the plaintiffs. The plaintiffs themselves get nothing but crap, the shaft, or both.

Let me explain to you how this works. You see, the corporations finance Team America. And then Team America goes out and the corporations sit there in their, in their corporation buildings and, and, and see that's, they're all corporationy, and they make money.

You truly are an idiot if you believe this has anything to do with the war on terror..this is about eroding civil liberties and personal rights in the name of the "war on terror"
If there was truly a war on terror Syria, Iran as well as North Korea would have been invaded by now.
Not to mention seizing the over a trillion of the Saudi Royals dollars currently sitting in US financial institutions,,the war on terror is a war on YOU

Oh and not so sexually frustrated..father of 2, 41yrs old with a 27 yr old wife.

I would be very happy to know what it means to win the war on terror. If any person here can explain to me how we define victory in this I would like to hear from you. Without a clear definition of victory it will not be possible to win. EVER! Like any sensible, rational person I have no problem with my duly elected government taking extreme measures to defend our nation in time of war. Look at some of the things we did to win WWII. Even after the war allied soldiers killed innocent civilians to get people to turn in resistance fighters in Germany. I personally have no problem with this. BUT until you have the stomach to do things like this don't use the word WAR so lightly. If this was war, Pakistan would be occupied now because it is Al Queida's primary base of operation and training. Half assing a war gets you a Vietnam or Afghanistan (to the Russians). We are not at war. That is a pleasant euphemism to get people riled up. Get over it and use some common sense. Do not grant broad Powers to your Government for a war with no clear end. They cannot be trusted. The Forefathers of this nation knew that and we should never forget it.

Re: War on Terror

Why haven't some attorneys filed a class action lawsuit against firefighters yet? I mean everyone knows that firefighters are just pawns of the Bush Administration who purposely set fires so they can stomp all over our civil liberties and break into our homes while they claim they're just putting out the fire. Whatever! We know what's really going on. Fascists!

Funny you should say that. A long time ago a friend of mine had his house burn down. In his infinite wisdom he kept some pot in a fire proof bag. A fireman opened the bag and found the pot. The judge threw out the evidence because there was no probable cause to open the bag.

when the use of the euphimism "war on terror" I believe that that is what the present administration is using to "elevate" their so called war "powers". If anyone has read the constitution, there is not any mention of the president having extraordinary powers, that is what concerns me, this present administration is claiming to follow the constitution, and want judges that are strict followers that don't interpret said constitution, and then lambast them when they do. We have three branches of government, but you would think that there is only one and if you disagree with them, you must be weak on terrorism. Both houses of government have become impotent. They are/were elected to serve us ,and they need to be made aware of this fact, or they need a rude awakening. As a Vietnam vet, 2 tours of duty, I am truly disappointed for a couple of reasons. One is that how you could start a war that you can't possibly win (remember the past),and once started how could you be so unprepared for the peace? (remember the past again). I am a conservative Democrat/liberal republican, no that is not an oxy moron.I like the physcal responsibility of true conservatives, but with a touch of the true democratics compassion. I don't want any religion in politics, not even my own. This socalled war is bogus from the getgo, just as Vietnam was.I had the choice to go or not go, and chose the former, and don't regret it. It gives me a better slant on what is going on. JMT

Some of you are going so far in your criticism that it almost seems you would literally like to see us lose. I hasten to add that this isn't because you are disloyal. It's because you just don't recognize what losing means. Nevertheless, your conduct gives the impression to the enemy that we are divided and weakening. It concerns our friends, and it does great damage to our cause.

For those who don't know the enemy...the enemy are the same ones who would throw you off a building, cut off your hands, cut out your tongue and otherwise murder you just for disagreeing with them.
