RIAA Can't Beat Mom, Targets Kids
Children of Patricia Santangelo sued...
Already $24,000 in debt before the trial even began, mother Patricia Santangelo, 43, was sued for file-trading by the RIAA but decided to fight on principle. Her battle quickly became famous Internet wide, and many individuals and groups decided to donate to her legal defense. With that case not going particularly well, RIAA lawyers have now filed suit against her children, according to the Associated Press. The two are being sued for sharing some 1,000 music files.

This is an outrage, and only more proof that we need a loser-pays system (limited only to requiring a losing plaintiff to pay for the legal costs of a winning defendant) for our civil courts. No one should ever have to pay legal expenses if they are the victims of a frivolous lawsuit.

We also should extend the protections of 5th Amendment to the civil law system. Anyone who files a civil lawsuit should be require to prove beyond a reasonable doubt that they were indeed wronged.
