The Brazilian Senate is considering a law that would make it illegal to send an e-mail, join a chat, write a blog or even download content anonymously. "The bill states that every user must fully identify herself before using the Net, with full name, current address, phone number and the equivalent of the Social Security Number. To access the Net without providing this information, or to give false information, will also be a crime." The bill also forces ISPs to retain all user activity for a period of three years.

I can't believe Bush would sign this law! This is proof he is a pawn of special interest. Internet tax, here we come! I swear I'm going to picket in the streets of Rio de Janeiro for this... eh? Brazil?? Oh... nevermind.

Seriously Senator Eduardo Azeredo (who wrote this silly law) used illegal campaign funds for a re-election bid last year. One has to wonder just how far this bill will make it.

What's wrong with identification requirement

There is some good stuff in the bill - it prohibits spreading malware, breaking into systems etc.. Hardly anyone, I suppose, would object to these parts.

The problem with the removal-of-anonymity part is that every such coercive measure is always abused to the maximum.

Here are a few of the more obvious bad outcomes that are likely with this kind of law. Or in other words, reasons that anonymity is a Good Thing.

    •If the government doesn't like opinions you express, you may get hassled, prosecuted or worse - on some other pretext, of course.
    •If your employer doesn't like opinions you express, you may lose the job (maybe on some other pretext).
    •There may be freedom of speech now, but later laws may restrict what may be said - e.g. racism or offending certain groups, as in Europe.
    •Chilling effect on what people are willing to express, because of above items (self censorship).
    •It may later leads to an "internet license" requirement which would be designed to keep disfavored people offline.
    •Cyber-bullying, as has happened in Korea recently, is bad enough online, and this law would make it easier for hostile people to find out your physical address.
    •Site operators would make deals with advertisers, and then your entire online history would be sold and live forever in corporate databases, all with reliable, real-world person-identifiers.
    •Someone uses your credentials and whatever they do is legally attributed to you.
    •When you complain of others' behavior online, the authorities will say "Sorry we can't help; despite the law we couldn't identify that person" - maybe they just don't want to take the trouble. But if *you* break the law you are prosecuted.
    •Criminals, of course, will carry on being anonymous.
    •... too many more.
The current unreliable way of identifying people, where they have to trace someone by IP address, is an appropriate barrier for bad actors (including unscrupulous governments), but not too severe a hindrance in case of real crimes.

and their politicians are pissing me off. I understand full name, I do not understand current address, phone numbers, and SSN. The US is already the number one country for ID theft, Bush would just make those crimes GO UP if he signs a similar bill to this. I am already pissed off that my SSN is on all of my progress reports at school, and used everywhere basically as ID, do I really want some random people online getting their hands on such sensitive information like my SSN, or current address? Imagine all the prank calls you get just by posting your phone number here on DSLR, now think about putting your number on every site you go to.

Hey, I once worked for a company that made you punch out to go to the bathroom. If you went too many times in a day, you would get a verbal warning, unless you could prove it was necessary because of a medical condition.

Even the Brazilian Ministry of Communication is against this bill. From what I've been reading (first-hand, none of the babelfish crap) just about the only people for it are the guy who wrote the bill and the digital-signature companies. Everyone else thinks it's a travesty.

I wouldn't worry too much about this passing, then again, I didn't worry too much about communists winning the governorship in my home state and they just did.
