Verizon Sues Over 700Mhz
Slight chance of change worries lawyers...

When the FCC first released their rules on the upcoming 700Mhz spectrum auction, the phone industry was outraged that they might not be able to transfer their closed, restrictive 3G model onto any new broadband network they might build with obtained spectrum. Verizon lobbyists argued that the increased choices you might gain from an open network were actually bad for consumers.

Then, once they seemingly realized that the rules were full of loopholes that maintain the status quo, both Verizon and AT&T quieted down. Now that Verizon lawyers have had more time to dig through the rules, they've apparently found some language they didn't like -- and are suing the FCC. They're now calling the rules "arbitrary, capricious and…contrary to law."

Google posted a comment to their blog stating that:

"It's regrettable that Verizon has decided to use the court system to try to prevent consumers from having any choice of innovative services. Once again, it is American consumers who lose from these tactics."
Of course, as some have noted, if a bidder plays their cards right, it's possible to win the spectrum with no conditions whatsoever.

All in all..

Everyone is just too sue happy these days. No matter what the FCC does, there's always going to be some sort of wording loophole or some policy that someone doesn't like. If ISP's put all this money they're spending on legal matters into their infrastructures, we'd be a lot better off.

Yeah, seems like that it's the only way a company thinks it will survive is to just sue everything in sight. It's rather sad that all those resources are being wasted on such a thing when they could be used for much better things such as building out infrastructure etc..

I don't think everyone is sue happy...but it sure seems like Verizon is.

Seems like Google uses the courts all the time when it suits their purposes. It is a little disingenuous for them to whine about Verizon using the courts to protect their interests.

VZ is simply protecting their investment...with their infrastructure in place...why should they share the billions they spend on spectrum with others...if Google wants to play the wireless game, then they need to play like everyone else. IMHO.

The FCC rules has nothing to do with sharing their spectrum with other companies. It's about allowing consumers to use any wireless phone they want instead of just the carrier approved models. It also will prevent them from crippling or blocking applications you run on your phone.

Man verizon sucks i may drop their service for crap like this. They want to control the iu on your phone which is pretty lame now. Man i was looking forward to the open spectrum. i guess we will have to see what happens. Unlikley vzw will win though.

Huh?

What is unlawful about it? Spectrum is owned by the public, if a company wants to use it they have to enter a contract with the government elected by the people... though we may think the FCC is stupid they're all we've got, people don't care enough to make them an election issue.

I know there's lots of weird laws out there, but as long as we're not violating Verizon's statutory rights, can't we make whatever contract we want?

Cellco Partnership Should Not be Allowed to Bid

Someone in another forum made the comment that by filing the lawsuit Cellco Partnership was violating part of an anti-trust law. I am curious if this is true. If so, then no 700hHZ for them.

...then they should decline to bid. That will show the FCC!

Seriously, Verizon is one of the most closed companies in the wireless business. The whole concept of open access must be truly frightening to them.

Verizon Sues Over ...

If Verizon isn't suing because of public patented technology. They are suing cause they can't stay closed off and be their own wireless country. I mean Verizon thinks they invented wireless, IP traffic, the internet, modems, and more. What will they sue next the UN, UK, USA, or NASA because of whatever trivial thing has bite their ar*e. Come on Verizon you are not the supreme god of all existence.
