9 States Subpoena Sprint, AT&T
As "Tough" Merger Review Rolls On
by Karl Bode 08:50AM Tuesday Jul 12 2011
Accoring to Reuters, Sprint has received subpoenas in nine States regarding AT&T's planned $39 billion acquisition of T-Mobile. Both AT&T and Sprint say the companies have received subpoenas and civil investigation demands from attorneys general in the states of Arizona, Florida, Hawaii, Illinois, Minnesota, New York, Pennsylvania, Texas and Washington, as well as from the Antitrust Division of the U.S. Department of Justice. While this show of a "tough" review continues for now, it's expected that AT&T will see full approval sometime early next year -- with only a few select conditions applied to the deal despite its significant potential impact on competition and prices.

Won't Matter

This is so funny. It is almost as if government at all levels is trying to convince us that they might be performing some sort of oversight.

But rest assured, this merger is a done deal.

Re: Won't Matter

sprint probably realizes it's a done deal... the show they are putting on is probably more about increasing concessions than stopping the merger. i'd think the feds would receive most concessions though, not sprint.

an interesting sprint analysis...

Re: Won't Matter

Exactly - this is a chess game here. This may get a little financial concession - but I'd expect Sprint to get something (spectrum deals, or otherwise), and in the same deal, put a little squeeze on AT&T, and make them pay one way or the other (financially, rules, concessions).

This merger is a done deal and right now policians are trying to get their bribe money to decide the level of sanctions they will require. I bet all the money in the world that it won't be a requirement to provide uncapped unlimited internet.

Everyone knows this merger is a bad idea for competition especially with all the cap and per byte craziness.
They do not need any level of inquiry to waste money, it is simply do you want more or less competition - "yes" or "no".
The American people say "no".

That is a sure bet - and if it was somehow by a miracle to get put in the merger approval, it would get overturned in the courts for sure.

Eh, I doubt AT&T would fight it. I mean, who's going to enforce it? The FCC?

AT&T has paid enough in "campaign funds" to Congress; congress will do what they are told to do, they love the "gifts" and "campaign contributions".

Re: History?

AT&T was the antitrust case to dump the baby bells so they could get in the computer business and just deal with long distance. The problem was they were so use to taking 5 years to make a decision they could not compete in the computer world. MCI and others that followed changed the long distance business to the point it almost free.
To the t-moble merger they are no longer the low cost carrier maybe just a mid cost carrier and their parent company want to sell them off. T mobile is going to disappear one way or the other. The world did not end when Verizon bought Alltel.

Subpoena Sprint over Network Status

Somebody needs to get Sprint to start coughing up info on the poor backhaul and halted 4g rollout.

If I didnt have WiFi I would be going insane.

Waste of TAX money

This is a total waste of tax money. The states have NO say so in this matter at all. The Antitrust div of the USDOJ will do little as no laws will be broken as far as they're concerned and the Sherman Act will NOT be used in this matter later if it will go through.

Sprint is just pissy that they didn't get to buy out TMO instead.

AZ, FL, HI, IL, MN, NY, PA, TX and Washington ALL need to get back to regular business. And as far as MN- LMAO! They're currently closed as they have NO budget to operate! LMAO! Way to go MN! Spending more money you don't have on stupid shit!

well, it's time to break the addiction.. -cancel your accounts-
consumers are addicted to oil, therefore gasoline prices can run high and higher (never low) with the fortunes of vegas and the stock market (gas prices won't crash unless you can get a cheap car that'll run on air or water). consumers are addicted to smart phones (especially the younger generation) so now there is a duopoly who thinks they can raise prices and gouge consumers. and you expect this to go off without a shot fired in the name of consumer advocacy?

sure, it's a long shot it would shoot down the merger, but on this one.. can't blame sprint for trying... unless your an AT&T stock holder.. I don't trust sprint either as far as I can throw them, but who else has a company position that services should be cost effective/efficient for the consumer instead of profits for the sake of profits? this is more a enemy of the worse enemy is a better friend idea here (strategically, Sprint is screwed 15 billion investment is a drop in the bucket compared with 600 billion AT&T and Verizon are prepared to pony up in a race to overlay 4g networks criss-crossing every major metro area and gobble up the most valueable wireless spectrum in the process).

as I've said before, we're done with the -ism's of the 20th century.. now in the 21st we have "-ing"s..

some great current ing's:

fearmongering
monopolizing
duopolizing
gouging
merging
reforming (to what end?)
corporatizing
squeezing (middle class and poor)
taxing and loopholing

I doubt even Jibb Jabb can do this one justice...

BTW, there's probably a secret deal pending to get 95% blanket wireless coverage so that the PSTN phone network can finally die.. just like analog tv died even though there are plenty of spectrum dead spots. This will just be imposed upon consumers without much public debate or input. Welcome to post democracy Incorporated States of America

Getting subpoenaed, doesn't necessarily mean you did anything wrong. They could just want to hear Sprint's case against the merger.

Then they should send an invitations. as far as I understand a subpoena is a mandatory appearance.

Have any mergers ever been turned down by the government?

Well, really? I can't think of a single merger that our spineless government has stood up to yet. Let me know if I'm wrong.
