AT&T, Verizon Drop 3G Ad Dispute
Can't we all just get along and make billions?

A few weeks ago you'll recall that AT&T sued Verizon Wireless for a new series of advertisements poking fun at AT&T's 3G network performance and coverage. Specifically, AT&T told us they believed the ads "mislead customers into believing that AT&T does not offer any wireless service in the vast majority of the country," despite the fact that the ads simply compared 3G coverage only (see example ad). What followed was several weeks of media coverage, which actually made things worse for AT&T -- by highlighting the very lack of 3G coverage and poor network performance AT&T's been trying to downplay for months.

After all of that extensive sound and fury, AT&T sent us an e-mail this afternoon noting that the dispute has been settled, and AT&T has agreed to drop their case. Aside from providing us with the appropriate legal documentation (1, 2 pdf), AT&T wouldn't comment on why the case was dropped, though given the courts already denied AT&T's request to have the ads pulled, it's likely because AT&T lawyers didn't think they had much of a shot in winning.

Interestingly, the documents highlight how Verizon dropped a case of their own that they'd filed against AT&T back in July, asking the courts to rule their claims of having the "Most Reliable 3G Network" were actually true. Verizon, you'll recall, recently got the National Advertising Division of the Better Business Bureau to rule they, not Sprint, could claim the most dependable 3G network in ads.

It's really all been a bit silly, given the only thing really accomplished by the media blood feud was that millions more people saw AT&T and Verizon advertisements ahead of the busy Christmas shopping season. Hey, wait a minute....

It was intended to draw in people for Black Friday / Cyber Monday, and into the holiday season.... It did its damage. May not appear to be much, but then again, next quarters results will show.

If ONLY the Consumer Reports wireless report was available a couple of weeks earlier.... it would have just added more fuel for the fire.

I'm not so sure. I had several friends ask me about the ads and I know one decided not to get an iPhone because of it. I realize that is a minuscule sample size, but I can't be the only person who was asked.

On the flip-side, when my girlfriend saw the Apple/AT&T ad about no voice/data at the same time, she asked me if that was true.

That's exactly what they want to happen. You'll remember the ad because you're annoyed by it.
I'll remember the ad, but it sure won't make me want to use their network. Just the opposite.

It isn't like AT&T is a company that NEEDS name recognition. For a company needing name recognition, an irritating ad may help them. But AT&T only hurts themselves with irritating ads.

And you notice how they are careful to NOT say what coverage they are talking about. You are supposed to assume that they mean their EDGE and/or 3G coverage but they are (apparently) actually talking VOICE coverage.

I agree with at&t that the VZ ads were misleading.

Yes, I know the ads say 3G coverage. I've seen the ads a few times each. I've paused the ads, seen screen shots of the maps. And they all clearly say 3G. But.....

I decided to look at the commercial like a normal person (not a techno geek) and at normal speed, and my thought process went like this:

Oh, another phone commercial.
Verizon coverage ad.
Coverage map.
Now at&t's coverage map.
Wait, is there really that big of a diff.
Wait, I was still comparing.
Verizon blah blah.
end.

I looked at each map a few times and before I could finish, they, along with the legal 3G disclaimer, were gone. I did not have time to read that it was 3G only.

Then I realized I am surrounded by tech geeks (dslreports and work.) So, as a quick survey, I asked a few family and friends if they have seen the commercials, and if they knew what 3G was.

All 10 have seen at least one of the commercials, and only 2 knew that 3G was the "faster wireless data" service. Only 2 knew that they could get voice/2g service over a much larger area. The other 8 said that they thought that the map in VZ's ad was all of at&t's coverage.

Now, the part that I thought was misleading was VZ's ability to label all of their coverage as 3G. Yes, the naming org. said that it was 3G, but if you read the fine print on their website coverage map you will see that speeds up to 1.4 mpbs are only availible in EV-DO rev. a upgraded areas. All other areas will see sub 700k speeds. Hrmmm, pretty close to at&t's 2g service. Where is the map that shows VZ's upgraded area to at&t's 3G coverage?

Due to a naming anomaly, VZ can say their entire network is 3G, but lets compare apples to apples. I want to see their slower network compared to at&t's edge network and their upgraded area to at&t's 3G area.

What's sad is that I hear radio ads for AT&T where I am - and there is no 3g from them in this area! Faster, perhaps, but not here!

...Also, Verizon recently bought out lots of Alltel's turf... they've basically assimilated Alltel's 3g, which is probably why those maps look so full of red...

If Verizon REALLY wanted to upset AT&T, they'd license the ol' Beastie Boys song, "Ill Communication" for their ads

This is too funny! They basically sounded like little children when it came to the stupid 3g ads. Honesty I don't care if AT&T doesn't have 3g coverage in the middle of nowhere mississippi. As long as I have coverage in my general area I'm pretty much set!! Verizon can try as hard as they can to get my money, but unless they come out with a REASONABLE selection of GOOD smartphones, you will never see me pulling out my wallet for their junk.

Vz ads

I'll bet people in the middle of Nowhere Mississippi care if they don't have service (BTW, isn't Patterson basically Nowhere, CA?). The point is that VZ got ATT off their message and put them in defense mode. Now ATT is spending tons of money telling everyone about their coverage instead of delivering a message that makes you want to go out and sign a contract. That's a Mastercard moment for VZs advertising agency.
