Who said they should be effective in stopping. The illusion of doing something on a low risk issue and keeping industry happy and getting donations is the aim and they are doing it well.

I remember when that really was the law. Back then, any encryption software was considered munitions. If you wanted to have 128-bit SSL on your web browser, you had to order a special diskette. To get the diskette, you had to provide all of your personal information, swear an oath of allegiance, cross your eyes and hope to die, etc. etc.

Some of the changes makes sense, but parts of it looks like nothing more than an attempt to pay off those who want to control when, how, and what you listen to (and a few other items).

I think they are lumping those who copy music for personal use or trade into the same boat as those who counterfeit money and shoot people who look like they may be trying to cut into the action.

How about "If you're not doing anything illegal, you have a lot to worry about." The government is going to far in helping private businesses and criminalizing everything. It would not be a far stretch for the government to be able lock up anyone because some obscure law was violated.

Homeland security should not be involved in such issues as DMCA and music downloads. None of these are threat to any security involving the homeland. Spread the homeland security resources too thin and you really weaken the defenses against very real and significant threats.

It would appear to me that Gonzales has just benefited from a donation by the RIAA and MPAA. He has been purchased.

It makes perfect sense, pirates are a complete threat to the homeland and as US citizens, they should be considered top terrorists. By all means should the US government come to the aid of such a big industry like the RIAA. It would be totally foolish for them not to!

Maybe the thinking is, piracy threatens businesses' profitability. Businesses' profitability keeps the economy strong and, by extension, the nation strong. Undermining businesses undermines the economy, which, in turn, undermines the nation. Therefore, pirates are subverting national strength and therefore security and are a threat best dealt with by DHS.

Just a guess.

Well, that's almost true, except that now they've added "INTENT" to the equation, and under the PATRIOT (and as a retired member of the US Military, I really resent the use of that word as the title of such an unconstitutional knee-jerk reaction pack of 'laws') Act, you're in deep doo-doo these days if someone so much as drops a hint to the 'right' authorities that they think you're acting in a strange, possibly terrorist planning way (whatever the hell that is? taking flying lessons maybe?)

As someone else said earlier: quit making new laws you can't enforce anyhow, that cost zillions to even attempt to enforce, that really don't target the source of the problem anyhow, and that you already have laws on the books to deal with: enforce those a little more vigorously!

The biggest changes I see are:

1. In the past most copyright issues have been handled via civil punishment and not criminal punishment. This makes downloading that new Gwen Stefani song a felony.

2. This law targets P2P and usenet search engines. It's now illegal to "aid and abet" copyright infringement or commit conspiracy to infringe on copyright. Hell, with as vague as the law is written, it could make usenet illegal.

3. This law makes it legal for federal law enforcement officers to obtain a "wiretap" for suspected copyright infringement.

Goodbye usenet and P2P search engines based in America if this passes.

It's almost weekly something happens that makes me want to disown this country and move away. I agree with protecting copyright, but treating everyone like a felon is not what this country is about.

Perhaps DSL Report should read the press release and the proposed law. This is very sloppy journalism to rely of bias and sloppy second had information. All the law will do is harmonizing music fraud and counterfeiting, AKA piracy of songs, to existing counterfeiting and copyright laws. Frankly, the person running a server serving thousands of pirate copies of songs should not be treated or prosecuted any differently than the smuggler moving and other form of counterfeit goods.
As for the mentioned Department of Homeland Security, there only one mention in the entire act to quote:

"(4) Notification of importation.- The Secretary of Homeland Security shall issue
regulations by which any performer may, upon payment of a specified fee, be
entitled to notification by United States Customs and Border Protection of the
importation of copies or phonorecords that appear to consist of unauthorized
fixations of the sounds or sounds and images of a live musical performance.”

All it has to do is about is the discovery of importation and notification concerning counterfeit copies by the Customs department.

There's a reason we have Civil and Criminal courts. Nothing to do with copyright infringement should EVER be in the criminal courts. Frankly anything that doesn't involve some sort of violence towards another shouldn't be in the criminal court.

You should not go to jail for taking a picture of someone else's picture, or playing a song out loud in a public forum. That's just ridiculous. But of course, once we're all classified as felons, only the pols will be able to vote, and we'll no rights anyway.. ridiculous.

"Strengthening Penalties for Counterfeiting Offenses that Threaten Public Health and Safety

Some counterfeit goods create serious risks to public health and safety. For example, a
counterfeit pharmaceutical may be ineffective or harmful, or a substandard electrical cord bearing
a counterfeit UL certification mark may pose a fire hazard. Such threats to health and safety are
among the principal factors considered in deciding whether to prosecute intellectual property
cases criminally, and the Department's Task Force on Intellectual Property has identified these
types of cases as being a prosecution priority. To better reflect the seriousness of IP offenses that
pose health and safety dangers and to provide greater deterrence against such crimes, it is
appropriate to provide increased penalties for counterfeiters who deal in dangerous products.
Accordingly, section 12(a)(l)-(2) provides enhanced maximum statutory penalties for
counterfeiting offenses that endanger public health and safety.

The proposal increases the
maximum penalties for offenses from 10 to 20 years imprisonment where the defendant
knowingly or recklessly causes or attempts to cause serious bodily injury, and increases the
maximum penalty to life imprisonment where the defendant knowingly or recklessly causes or
attempts to cause death. Both the mens rea standard ("knowingly" or "recklessly") and the level
of enhanced penalties are consistent with other existing federal criminal statutes that provide
enhanced penalties for offenses resulting in serious injury or death."

Ouch! From 10-20 goes up to life. Fake Viagra makers beware!

Rehash of last year's bill by the same name - it's doomed

I predict that like last year's bill with the same name,
it will end up in the Congressional dustbin. The chances
of this getting onto the floor of the House/Senate are
very slim.

First of all, there are more important matters for the
do little Congress to consider - a copyright infringement
bill is going to be very low on the totem pole.

Second, given Gonzales recent troubles with his
testimony over the fired US Attorneys, both houses
aren't going to be favorable toward him right now.

Whether or not this gets taken up by congress depends entirely on if the MAFIAA can make enough campaign contributions to make it worth congress's time to look into it. Its legislative merit has little to do with it.
