Scolds Netflix For Conflating a Protocol With Piracy

BitTorrent has been absurdly sensitive about how people might confuse the protocol Cohen created and the business he's trying to create, with the fact that it has been used for years for piracy. Yesterday I noted how the company won't even let BitTorrent proxy and VPN services like TorGuard advertise within the BitTorrent client, fearing it might be seen as supporting piracy. Now the company is also freaking out about comments recently made by Netflix that stated that wherever they launch, BitTorrent traffic drops.

Netflix's conflation of a protocol with piracy upset the folks at BitTorrent, who took to their blog to set the record straight:

BitTorrent was designed to move data. It was not designed for piracy. In fact, as a stand-alone tool, it’s not even a very good technology for piracy. We have never hosted infringing content. We have never endorsed it. To be clear, we are not a file-sharing site. Our technology does not rip DVDs, nor does it capture movies in the theater. We have never pointed to, indexed, or promoted infringing content in any way.
This ultra-sensitivity comes from the company trying to hash out content deals as they promote BitTorrent live. They want the recognition the BitTorrent brand provides, but not the historical reputation that goes along with it. That the company still has to explain that a protocol itself is different from what's done with that protocol highly suggests that Cohen and crew might be better off with a new brand name.

Cohen can deny it until the day he dies, but while bittorent is a protocol that can be used by legit services, it was designed for piracy and it is still the major use for the protocol.

If it was designed for piracy, why didn't Cohen start TPB? He didn't really cash in, and doesn't seem to have a political agenda, so if he is a pirate it must be on a deep subconscious level.

Up until 2005 Cohen maintained links to illegal content on his site. Only then did he decide to go legit in order to get his product used for legal reasons. As many startups did he used illegal porn and illegal downloading(just like YouTube) to grow his business.

2005 Cohen and Navin made a deal with the MPAA to remove links to illegal content on the official BitTorrent website.

This is the equivalent of saying the inventor guns (10th century Chinese fire lances) intended on killing people so ALL gun owners intend to kill people.

Its just not true. Guns are a tool, just like bit torrent. The user is left with the decision of whether or not to do something illegal with it.

BitTorrent programmer Bram Cohen may be in legal jeopardy after the discovery on Wednesday of an old agenda buried on his website saying he creates programs to "commit digital piracy."

The polemic would have been of little interest a week ago. But on Monday, the Supreme Court ruled that the intent behind a file-sharing program can be a decisive factor in determining whether the creator can be sued for its users' copyright infringement.
