Cable ONE Latest Hit With Snoopvertising Lawsuit
NebuAd's shadow extends well past its demise...

You might recall that before snoopvertising agency NebuAD flamed out spectacularly, a number of ISPs tested the user-tracking technology on their customers -- in many cases without telling anybody about it. When asked by the press about the tests, many of these ISPs simply wouldn't comment. Ultimately WOW, Charter, Embarq and all of NebuAD's clients faced a public relations disaster when their quiet tracking of your online behavior became public, so they suspended their efforts. But now each of those carriers is facing legal action, with Cable ONE being the latest according to Courtroom News:

A federal class action accuses Internet provider Cable ONE of "interception and eavesdropping" by installing devices in its broadband network so that NebuAd, an Internet ad company, could place targeted ads in Web sites visited by Cable One customers. Samuel Green claims Cable ONE installed the devices for several months and was paid a "price per customer, per month" by NebuAd. . . Cable One did not inform customers of the "infiltration" and did not give them an opportunity to opt-out, the complaint states.

Of course many of these ISPs made things worse for themselves by simply not being transparent with their users. Carriers were so excited by the possibility of a new revenue stream (rumored to be around $5 per user, per month), that many were willing to bypass all privacy and consumer concerns. Several ISPs made things even worse by lying before Congress in August of 2008 about the depth of their information sharing and the usefulness of their opt-out systems. While many ISPs didn't even bother with opt-out systems, other ISPs implemented cookie-based opt-out systems that simply didn't work.

And the service credits will be offset by increases in the cost of service.

Is there an actual example of a class action lawsuit in modern times that actually got some measurable, tangible form of compensation for the plaintiffs? It seems that all of these follow the simple template of the defendant paying the leeches lawyers to go away and giving the plaintiffs themselves some token form of "relief" that can only be used to purchase a new set of goods or services from the defendant.

I look at class action lawsuits as doing a job the government should be doing, and isn't. I have been involved in one and didn't expect any money, but it sure made the company modify their behavior. Does the tobacco settlement mean anything to you? It went beyond a mere token settlement.

Until companies face actual fines that will make a difference, they will continue doing such things.

The worse that can happen is petty, small fines which they don't care about

And even if some massive fine hit them, it would just be tacked onto bills in the future

this is typical..

of how corporations are focused ONLY on profit. If it means selling customer personal data, they will definitely try to get away with it. As long as they don't get caught and sued, they don't give a rats arse about customer privacy. If a judge gets upset they usually try to slip the judge money under the table.

Does anyone know exactly what laws the defendants violated? How were the plaintiffs damaged? Theories? Lets not talk about those, just exact laws.
