Cablevision Beats Verizon in DVR Patent Fight
Verizon's Attack on Competitor Falls Flat

Adding some extra tension to their already heated battle over broadband voice and TV customers in the NY Metro area, Verizon last year sued Cablevision for violating five DVR patents. As is usually the case in these suits, some of the patents involved were painfully vague, such as a patent for technology that "allows users to navigate available programs by channel, and through the selection of an anchor channel, by category." More than a year later, and a court has ruled in Cablevision's favor in four of the five patent claims. The fifth patent had already been invalidated in a Virginia court. "This is a significant victory for Cablevision," said Jim Maiella, a spokesman for Cablevision. "We are obviously very pleased, and will continue to defend ourselves vigorously as the process continues."

Most of these "process patents" claims should be invalidated. That whole category of patents is usually abused by allowing patents for common sense ideas.

I guess they could be legit for some engineering process where some 17 step manufacturing process allowed for the creation of some unique chemical compound or drug. But when they allow patents for double clicking a mouse button after going to the bottom of a computer screen it is absurd.

It's my personal belief that most software patents are absurd, If they must have them, they should put a reasonable time limit on them. (like drug patents)

but if you're a smart drug company you can get your patent to renew. That's why most drugs still do not come generic. Protonix is one of them. Nexium is another. You can get them at times by generic in hospitals but go to a drug store and get them- good luck.

I totally agree with that. My company is currently battling one. The patent is for a vending machine that vends any sort of animal food- including corn for ducks/geese. That what the patent states on its filings. The silly thing is it was submitted in 2005 when that same concept was being used LONG before then. Gum ball machines were set up in several wildlife parks around the country with corn in them- put in 25cents and get a handful to feed the ducks. Now this crazy actress decided to patent to make some money since her career didn't go anywhere.
