Canadian Law Professor Michael Geist notes that Canadian lawmakers are again pushing sweeping new surveillance laws. Mirroring U.S. leadership belief that warrants and privacy rights are a hindrance, the three-pronged legislative overhaul will focus on allowing the disclosure of ISP customer data without court oversight, requiring ISPs to rework their networks to allow real-time surveillance (AT&T can certainly provide tips), and expanding law enforcement authority to allow broader access to this newly farmed data. As in the States, a lot of the rhetoric supporting the bill focuses on stopping child pornography and other Internet bogeymen, while ignoring that current laws already work well to battle such crimes.

Nothing really new here Govt's have always tried to skirt around the laws protecting the citizen and police/etc will do worse.

It's no longer "innocent until proven guilty" it's everyone is guilty until we let them be innocent.

But when there's a dead body, of course the police are going to take their own sweet time waiting for a warrant rather than just gathering evidence immediately. When Whitney Houston died, the police had to wait 8 hours for a warrant before they could recover the body and start the investigation.

The Canadian Conservatives are a bit better. Canadians believe in Evolution and other scientific facts. Our Republicans are out there. Just look at the Moon discussion.

Actually because we use the first past the post system, Canadian's have rarely ever voted in a Party with a majority of the popular vote.

I think harper was only voted in by about 40% of Canadians but asks like he represents everyone. Of course he's not the first PM to do so.

Thats why there are somethings I like better about the US system. You have a house and a senate. The housed based on pop. by representation and the senate which reps by geography. No entity in the US has power like a PM in a partliamentry style system.

The way the US breaks up the power is pretty cool in ideologic terms. In practice its a gong show. You get pork barrel politics and it can't be hard to impactful change. There are somethings I think we could learn from the US system (just as there are some from ours they could learn).

Still don't be confused. Harper doesn't represent the majority of Canadians. Most of our past PM's haven't either.

But only 2 typically get to form an actual government..The moderate right (Liberals) and the hard right (Conservatives). That's not much different than having a system of 2 relatively similar parties on your side of the border, just the choice is between the hard right and the even harder right.

If this mentality could be laid solely at the feet of conservatives, then Pres Obama is a Conservative.

I suggest that we begin to face the fact - the power that comes from surveilling and controlling citizens is an addiction.

Addiction to power (over us) is a sickness. It transcends ideology and party lines.

this is no violation of the law even the long view. That is the Kryllo decision.

The Supreme Court ruled 5-4 that the thermal imaging of Kyllo's home constituted a search. Since the police did not have a warrant when they used the device, which was not commonly available to the public, the search was presumptively unreasonable and therefore unconstitutional.
