Comcast P2P Settlement Lawyer Thinks You Should Take That $16
'The more people sign up the more Comcast has to pay...' he tells us.

Last week we noted how the guy who first discovered Comcast's P2P throttling right here in our forums, Robb Topolski, was warning people to stay far away from a settlement with the company that could wind up paying broadband users between $1 and $16. According to Topolski, people who paid $50 a month for throttled service will only see about 50 cents per month for each month that it blocked traffic -- and that kind of penalty really doesn't punish Comcast. Unsurprisingly, a lawyer involved in the Comcast settlement doesn't agree with Topolski. Eric Somers contacted Broadband Reports to make three points.

"First, it's true that some people are put off by the fact that each individual person only gets $16," admits Somers (technically, they get "up to" $16). "That may not be a lot of money, but the reality is this: the more people sign up, the more Comcast has to pay - up to $16 million dollars. The fewer people sign up, the less Comcast has to pay."

"Second, the recent FCC Court decision determined that Comcast did not violate any FCC rules or law," he says. "That means that Comcast has a better chance of winning at trial and getting off scot-free (and) if people want to make Comcast pay, the way to do so is to sign up for this settlement and get a share of the $16 million." Technically, the court ruled on the FCC's authority, not necessarily the Comcast action itself.

"Third, some might believe that if enough people opt-out of the settlement, then there might be another future lawsuit that would punish Comcast more severely," Somers posits. "Is that possible? Sure. Is it likely? No. The fact of the matter is that right now, signing up for this settlement is the best way to punish Comcast for its behavior."

While it's in-no-way surprising that the lawyers (who will of course get the lion's share of this settlement money) want people to sign up -- they do make a good point that something is better than nothing. This battle is largely over, and a follow up case focusing on this specific issue is very unlikely. That said, even the maximum penalty of $16 million for 30 months' worth of throttling amounts to about 0.0007 (0.07%) of 30 months of Internet revenue -- which really isn't much of a penalty for Comcast. Your call, Comcast users.

Wrong. The DC circuit ruled that the FCC's legal theory to enforce its Broadband Policy Statement was bunk. The court did not in anyway address the merit of the case.

Uh, according to the settlement documents, Jon Hart is lead plaintiff. So after posting some links Robb still doesn't stand to make money either way.

I sided with Robb. Yes, I know the chances of some windfall future settlement is unlikely but my principles are worth more than $16.

I don't abuse the court process. I don't extort subscriber money from providers. So no, I would not get a bloodsucking lawyer to extort $0.50 for subscribers and $3,000,000.00 for the bottom feeding waste of skin ambulance chasing lawyer.

All class actions should be opt in instead of opt out and bloodsucker fees should reflect the amount of WORK they actually did.

Unlike you, I think people should EARN what they make.

I've already explained it to you multiple times. Get hooked on phonics if you still can't follow the simple concept that THESE bloodsuckers didn't earn that money nor were they hired by everyone supposedly damaged.

That $3,000,000.00 comes from the subscribers genius. Surely someone so interested in capitalism realizes that Comcast doesn't print their own money. These are subscribers who weren't given a choice as to how much they wanted to pay for counsel. $3,000,000.00 is obscene by any measure and the result of a corrupt system; laws, written by lawyers, passed by lawyers, for lawyers.

But it doesn't matter how many times I will explain it. You will continue defending this corrupt system where supposed victims are victimized again for the benefit of a bunch of scum-sucking waste of skin ambulance chasers.

Congrats for choosing bloodsuckers over the subscribers. Enjoy your price increases.

If Comcast's lawyer is advising that customers take up the settlement offer to "punish" Comcast -- then perhaps Comcast should punish itself by donating 150 million extra to organizations like the EFF that are protecting fair rights.

He is not Comcast's lawyer - He is the Lawyer who brought the case and will be paid for his efforts. Thus by saying agree to the settlement, he is protecting the money he will reap once the settlement is approved. Thus although he is not Comcast's Lawyer he still has the same interest in getting the settlement approved as if he were.

If I roll into Congress or a state legislature with a prewritten law and a bag of money, I go to prison (lawyer or not) for bribery. The trial lawyer union does it and it's a contribution. sounds like you're talking about lobbying here, which is something your big biz buddies are at the forefront of. talk about gaming the system (can't believe you have the audacity to use this argument, "gaming the system"). trial lawyers don't have much when compared to the other side's favorable amounts of legislation. don't know how you can point the finger at trial lawyers in this instance.

All their money back!

These people who were throttled, should get ALL the money back which they paid during the throttled period simply based on fraud and false advertising. In addition, they all should be allowed to terminate their contracts without paying any ETF.

The penalty should be severe enough to dissuade Comcast and any other any other ISP from lying about fraudulent bandwidth and services, not a weak slap on the wrist. Fraud needs to be punished severely, with real economic consequences to the thief.

This does nothing for the consumer going forward. Nothing for competition, nothing for consumer (internet subscriber) privacy, nothing. Grab the $16 if you want, but in the end I see this costing you more in the long run. Large companies have a way of making RATE PAYERS absorb any additional costs to the company's bottom line. There are plenty of regulatory ways to MAKE comcast do the right things going foward by but this isn't one of 'em.

I have read some of the finer details and if you accept the $16.00, you agree to wave your rights on any future lawsuit or the right to disagree to any future terms changes, policy changes, and the most eye popper was the right to dispute any future disagreement in which you or Comcast could ever have (in the future).

I'll pass and not sell out my rights.

This is pretty standard in any settlement suit. Which is also why you shouldn't settle for something as insanely low as a handful of bills.
