Comcast Sues Sprint Over Network Patents
Companies No Longer BFFs After Verizon Deal
by Karl Bode Wednesday 22-Feb-2012 tags: legal · competition · wireless · alternatives · bandwidth · VoIP · Sprint · Comcast · Comcast · wireless
Last December, right after the cable industry struck their massive spectrum and marketing arrangement with Verizon, Sprint filed suit against Comcast, Time Warner Cable, CableOne, and Cox for supposedly violating Sprint VoIP patents. Comcast this week returned the favor, suing Sprint for violating numerous patents related to core network services, SMS/MMS, and 3G modem technology. The lawsuits come as Comcast phases out their wireless bundle offerings from Clearwire and Sprint. Comcast is seeking an injunction, attorney fees and undisclosed damages.

Waste of tax money

Much of the civil legal system results in noncollectable judgments and or decisions without any kind of prejudice so the whole thing can cycle again. Even more ridiculous is the people deciding the outcome of these law suits lack the expertise to even make informed decisions.

But the legal system is not to blame. They are handed this problem by congress which thinks it can legislate knowledge. Like the war on drugs this has never worked, and never will work. Ever.

Even more ridiculous yet is the fact that congress thinks you can legislate knowledge. Just like the war on drugs, it never has and never will work.

What you see is a version of MAD(Mutually Assured Destruction) theory used by US & Russia during the cold war.

The use of weapons of mass destruction by two opposing sides would effectively result in the complete, utter and irrevocable annihilation of both the attacker and the defender.

In lawyer parlance, if you sue me then I will sue you and each party will suffer unspeakable harm. Therefore, each side will step back and come to some mutually agreeable compromise.

And that is usually what happens. Except, as usual, the stinking lawyers and the judicial system make out like bandits, while the customers pay higher rates.

Re: Waste of tax money

Yes it is overly obvious this is a tit for tat.

But the bigger issue here is treating knowledge as property which doesn't work at all.

learning new knowledge, methods and techniques is a human quality that we should strive to promote not shun.

Universities are now starting to "patent farm" for both protection and fund raising.

IMHO, this is a travesty.

too bad greed is more powerful than logic.

This is why I want orgs like NASA to be who cracks interstellar travel. if the private sector does it the knowledge will be locked away under patents as vague as "A method to travel between solar systems"

From the actual news story.

quote:
No. 6,885,870: Transferring of a Message. Comcast claims that Sprint's multimedia messaging service (MMS) products for picture mail, wireless video mail and mobile email infringe on this one. Patent issued April 26, 2005.
sounds like it covers almost all MMS systems in general

also I do not see Comcast on the patent if I search it at Google or USPTO it lists Nokia as the patent holder.

Looks like Comcast bought the patent. They are shown as the current owner here:

and in a couple other places in a Google search.

Heh this sort of reminds me of the movie "Demolition Man".

You know, the one where after all the "Corporate Food Wars", Taco Bell was the winning corporation, so the only places you could eat were all Taco Bells.

Also it's "tongue-in-cheek" funny that "Bell" is part of the name...

Sprint

shouldn't sue their own customers and they wouldn't get sued in return.

one day I'm gonna wake up..

and see Verizon and Comcast want to merge companies...

let's not forget that it's only AT&T that overlaps the majority of the comcast territory (WITH WIRES).. not Verizon.. and maybe that would make it okay to gobble up a few wireless carriers.... NOT! afterall, in this increasily delusional coprorate world, doing bad by the consumer is the new normal.

3G Modem Technology?

Huh? What would CC possibly have anything to do with 3G modem technology?

Re: 3G Modem Technology?

and Sprint? they don't really own the patent to the CDMA-3g modem technology. it's 99% Qualcom.
