Microsoft and HP lead the pack

“Microsoft Corp., Hewlett-Packard Co. and other high-tech companies are preparing to push for data-privacy legislation next year to replace what they consider an outdated patchwork of state and federal laws that are inconsistent and burdensome,” according to a 9News.com report. Earlier this year, the companies joined the Consumer Privacy Legislative Forum to begin the push for such legislation which is designed to help increase online privacy in tandem with the increasing use of online record keeping. Opposition to the legislation is reported to be focused on a concern that this would set an example for an industry drafting its own regulations.

This may come as a breaking story, but there already IS federal medical privacy. It's called HIPAA. And most States prefer to deal with their own med privacy. California has the best consumer friendly laws so we don't need any Microcrap sponsored legislation. M$ embraces DRM and is in bed with the **AA's. Imagine the kind of legislation they're going to buy for consumer "privacy." The same kind of privacy you get from M$ when you have to activate their software. No thanks. Pass.

Usually when private interests push for national legislation, they try to sell it on grounds of consistency. They say it's to replace a "patchwork" of different state laws (they always use the word "patchwork").

But in every case I know of, what it really amounts to is weakening any regulations on what corporations can impose on individuals. That's because of preemption. Preemption means the federal law replaces the state laws on the same subject - even if the state laws are stronger.

This suggested legislation is not just about medical info, which HIPAA addresses, but about all personal info collected.

But I do think that a law passed to ensure data privacy is more about the rights of the companies collecting the info then about preventing dissemination of private info to outsiders.

When a company gets your info, which you almost always must give to buy their product or service, they usually include waivers allowing them to share your info with just about anyone they feel like. And I doubt any laws that this group supports would end that right.

Since you bring it up, I feel the need to point out that HIPAA is a complete joke. It makes it hard for health care providers directly involved in a patients care to communicate important information about said patients to other providers (IE: pharmicist billing an insurance company, doctor communicating with pharmicist); which wouldn't be so bad if it didn't leave a good deal of the patients private data exposed to anyone that isn't a provider that has access to a phone and a phone book.

I'll be interested to see just exactly how comprehensive and all encompasing this legislation will become..

I hope M$ recognizes this is a "GLOBAL" issue... not a "U.S." issue...

Failure to get other countrires to buy in on whatever legislation is pushed for is likely to meet with abysmal results.

What Microsoft and HP both want, is the ability to collect and store any information THEY want. The so called 'laws' are nothing more than the megacorps end run around state privacy laws. Guess what, I don't WANT microsoft to store any info about me. And in MY state at least, I am assured of that right through state laws.

This is where I and the damn gubmit part ways ...

This industry would not *NEED* to define it's own legislation if our lazy assed legislators who would rather take bribes from freakin' big business would get off their corrupt asses and get the legislation which is needed out the door.

Why don't they? Because other industries PAY THEM NOT TO...
