NebuAD CEO Bob Dykes (who I interviewed last February) appeared before Congress yesterday to defend his company's behavioral advertising technology, which tracks user browsing habits in order to deliver tailored ads. Forbes claims Dykes was "grilled" (usually code for softball questions with little to no follow up) by Congress, which seems split between those who believe the online ad industry should "self regulate" (like the FTC) and those who'd like to see some kind of rules put into place to protect user privacy.

With the NebuAD model, ISPs are paid (at least $2.50 per month per user) to host deep packet inspection hardware on their network that tracks your browsing activity, delivering it to NebuAD -- who in turn delivers tailored ads to the userbase. While NebuAD insists the system keeps your data anonymous, their cookie-based opt-out system has never worked properly, opting users out of tailored ad delivery, but not out of being tracked.

That could run afoul of several wiretap and privacy laws, something that caught the eye of Congress when Charter announced their plans to use the system last May. A number of ISPs (Charter, Embarq, CenturyTel, Knology) have since suspended their plans to use the technology out of fear of legal liability. It's now up to Congress to decide if they're going to do absolutely nothing to protect consumer privacy (the most likely), or stand up to the $11 billion online ad industry and demand such systems be opt-in (extremely unlikely).

Send data to NSA

Just have them send the data they collect to the NSA just like the phone companies do. They do it legally why can't NebuAD

Technically dumb hypocrites as well. I bet 99% think that an internet packet is something like the envelope they get their bribe in.

NSA most likely has a sniffer on most ISP's at the major nodes, and can pick off whatever traffic they want.

How do we know

How do we know that they are not implementing this now and just not telling people about it? Not just the ISPs listed above but other such as Verizon or Charter etc.? As and end user I have no way (that I know of) for me to know if my packets are getting read like that.

Where have you been? Charter is not using it. There are 50 stories about it here.

No surprise

Congress is concerned at the moment with appearing to be interested in voters due to upcoming elections. In reality, if NebuAd and their supporters pay enough, they will be allowd to go ahead. Congress is interested in business and money.

No, it's worse than being overrun by Republicans. They are overrun by Democrats who don't have the spine enough to stand up for their principals. At least with Republicans you could at least claim that this is stuff they really believe in.

(This comment coming from someone who disagrees with most of the Neo-Conservative stuff and who won't be voting for McCain come election day.)

Yah, NebuAD wants to know everything about us but what do you want to bet that CEO Bob Dykes hides behind a private phone number. Sure, NebuAD has corporate contact info listed but I'd bet he has a staff of people screening his calls.

In my opinion, NebuAD is just another scumware variant. These guys make used car salesmen look like boy scouts!

So we can expect congress to Tax the On-line Ad industry to get their cut and let the industry keep it's shady business practices. Nothing gets done in a system that hardly ever works to provide something positive to the end users without the "fine-print".
