Qwest: 'Don't shoot guns randomly'

Linda Crabtree and her daughter lost their DSL connection due to "random gunfire to a aerial wire," reports the Farmington (New Mexico) Daily Times. A Qwest spokesman suggests the best way to avoid such outages in the future: "Don't shoot guns randomly."

Sounds like "random" BS.

"Daryl Branson, director of the SJCCA, said the county was without 9-1-1 service for almost 90 minutes. After that time, "basic" service was available for land lines. Cell phone service, however, was not available. Full service was back in place by 11:15 p.m., Branson said.

Due to the nature of the problem, Branson said dispatchers were sent to "remote offices" in Kirtland, Farmington and Bloomfield to receive the emergency calls that were rerouted through local telephone numbers.

"We have a lot of systems in place that usually make it unnecessary to go to other locations," said Branson. "But because of the type of problem, back up (like the airport dispatch center) would not have helped. So we had to send dispatchers to Kirtland and Bloomfield.

Diana Culler, 50, said she noticed a problem when her home phone didn't work while and her sister-in-law Ginger, 44, said her cell phone was not operational."

Sounds like a bigger problem than "Random Gunfire".

This happens all the time in rural areas. The insulators on telephone poles that run through the woods are popular practice targets of hunters.

And given the fact that we are in the fall, now is hunting time.

I think you guys are looking way to deep into a simple case of "shit happens".

If they ever catch the people who are responsible then the telegraph company should make them pay for all of the costs incurred for performing the repair. The individuals should also be held criminally responsible for negligent usage of firearms and if someone who needed to call 911 could not. Given how much lineman overtime can be, this will quickly discourage other people from doing the same thing.

I'm sure they'd throw the book at someone for this (at least I hope they do). Unlawfully discharging a firearm into communications lines that carry emergency service? If somebody died as a result of not being able to reach 911, the individual could be prosecuted for manslaghter arising from negligence.

Catching someone in a rural area shooting at remote phone lines, however, is a much harder matter.

In the Unites Sates v. Enmons 410 U.S. 396 (1973) case, three members of the International Brotherhood of Electrical Workers (IBEW) were indicted for firing high-powered rifles at three utility company transformers, draining the oil from a transformer, and blowing up a substation.

However, the U.S. District Court in Baton Rouge, Louisiana, dismissed the charges on the grounds that, in the context of a strike, the militants' actions were not illegal since they were in pursuit of "legitimate" union objectives. On direct appeal, a divided Supreme Court affirmed 5-4.

That isn't a very accurate summary of the case.

The court held that a specific federal law dealing with interruption of interstate commerce could not be used in this case. The court even suggested in its opinion that these people could be tried on more appropriate state charges. The issue here is federalism.

The courts routinely use interstate commerce to encroach on states' rights. (Medical marihuana, anyone?)

That being said, in this case, the court didn't rule the way it did on interstate commerce grounds, making it a constitutional ruling; if it had, congress would have to change the Constitution (or enact a law out of the purview of the court) to change the situation. The currently introduced Freedom from Union Violence Act (H.R. 239/S. 618) would be moot if enacted.

If the court had found against the specific law, the Federal Anti-extortion law (Hobbs Act) would have been thrown out in it's entirety. The Hobbs Act defines extortion as "the obtaining of property by wrongful use of actual or threatened force, violence or fear. . ."

Congress had enacted the Hobbs Act specifically to eliminate the safe harbor for "legitimate" union goals. Nonetheless, the Court noted that the IBEW’s destruction of company property was part of a strike for higher wages. Since the demand for higher wages could not be considered "wrongful," neither could the use of violence to gain higher wages.

It was that word "wrongful" upon which the court's decision hinged. So now, the Hobbs injunction against extortion applies to rival businesses or individuals, just not to union members pursuing so-called "legitimate" union objectives.

I think it's semantics here: when somebody shoots at a powerline they lose the right to call themselves a "hunter"

The old any port in a storm approach was used as any excuse is better than none.Never mind no evidence or no mention of the exact science used to determine it was actually a bullet.Plus lets ignore the common sense fact, that there are more than one hunter in the woods during the hunting hours.

Also the fact people being so nosey today,Someone would have came to see "what kind of rack " the deer had.Deer season+ hunters with rifles = convenient excuse.Perhaps if they said it was caused by alien's from outerspace.There would be a chance between slim and none, that I would believe it.Oh wait look over there.Slim just left town

You would think there would be backup services in place that would automatically re-route 911 calls and not leave any gap in service. Glad to see our 911 fees are going for nothing.

Oh, its just not so with Qworst. Up until spring of this year, my department back in AZ had this problem anytime there was a cable cut. We only had one route in and out of town for all our phone traffic, and all 911 calls had to be routed out of town, switched in Tucson, and routed back to us. It was a real pain.

But was there any interruption in 911 service? Even with the calls being routed to another city someone is still on the other end of the line who can get help to where its needed. In this situation, 911 was down entirely for 90 minutes. Having it immediately re-routed to another city is a reasonable temporary measure until primary 911 is restored.

That is how our 911 system worked. All 911 calls go from our CO, on to a fiber run to Tucson, switched to a new fiber run and back to the correct dispatch office in our county. When ever there was a fiber cut in either of the two lines, we would lose 911, and the city and county would lose long distance. We had a few outages that were around an hour, and one that was just under two hours because they couldn't find the line fault. The Arizona Cooperation Commission starting hitting Qworst with big fines because of this, and this summer they completed a fiber ring for the whole county.

Our system out there is just such a mess mate... As far as I know, we haven't had anymore outages, but we still get 911 calls from "phantom phones" when it rains.

This situation sounds like your CO is a remote hung off of the host in another city, and Qwest is too lazy/stupid/ignorant to properly program your remote to internally route 9-1-1 calls when the connection to the host is lost.

Typical, instead of the cheap solution (properly program the remote) Qwest has to use the expensive solution (fiber ring).

I'm not too sure just how it is set up, but that would seem possible to me. I know that all local traffic between our CO and the others in the county would work when we would get these outages, but 911 and everything out of the county would go down.

Our 911 supervisor did once tell me something about how all our calls had to go to Tucson for some logging purpose or something, but I cant really remember the exact reason he gave.

I work for a cable ISP and believe it or not, this does not surprise me at all. We have had this happen a number of times in various areas where "rednecks" (or whomever it might be) shoot at birds or squirrels on lines. Poof they put a hole in a fiber or main line. The fiber cables are pretty well protected but not intended to put up with being shot. Yes, it unfortunatly sucks when it happens too because by the time the cut/split is found they are no longer standing there with their shotgun.

Blaming guns.

I remember as a kid we would shot at those things with sling shots. And guess what got blamed when we were lucky and brought down the system? Yup, you guessed it, some gun 'nut'. Of course that was before 911, so more people took matters into their own hands and did something instead of just sitting there wringing their hands saying "Oh is woe! 911 is down!".

I think it would be better to change the hand gun pic to a shotgun. Since living on a farm I have never seen anyone down line with a hand gun. A shot gun is a whole different story!

Besides I would rather have them shooting telephone and power lines then other people!

A gun range used by a friend was shut down due to people severing the power lines down range. A rifle can do it. Those yahoos don't stop firing if they miss with the first or first 20 shots. They'll fire until they hit it.

Major AHs. They have no idea where the rounds will land with the muzzle elevation needed to hit a wire.

Odd mix of problems

The article is quite interesting in who was affected & how. Seems it was a mix of voice, data & cellular service- but not all went down for all people. Sounds odd to me.

Then there's the matter of repair time. Qwest says 11:30pm, user quoted "1 or 2am".

This is pretty ridiculous, seems like something straight out of BB-Spot. I believe this happened, but this borderlines being one of those myths that is almost too ridiculous to believe.

No, it really does happen. But not just guns, other things people do bring those down. I had a friend show me an insulator he took down once, it was full of lead marks from what appeared to be .22 rimfire bullets, but could have been a strong pellet gun or sling shot with lead bullets. Hit enough times, they do crack.

Up here by me, there is a section of Sprint's aerial cable that runs along the road by the public hunting grounds. By the open fields there are splice cases randomly on the cable every 5-10 feet. Looks like repairs.
Probably bird shot.

Our WISP was getting their equiptment vandalized all the time.

They finally caught the culprit.

Don't know what happend after that but now it has stopped.

Birds sit on the phone line. Hunters shoot at the birds with a shotgun. Line gets hit by the lead shot. Then there is a lead short on the line. When the bullet is found in the cable that is how you know.

IT'S DUCK SEASON ! FIRE ! ! !

I recall an incident back in the 90's in a small town, near here... fight broke out at an after hours club, gunfire, nobody hit, hapless bullet came to rest inside a gargantuan, human leg sized overhead fib-op trunkline across the street.

Odds? Hell, probably better than hitting powerball, at any rate. Moral? Learn how to shoot before setting out with a loaded firearm to shoot... don't shoot while drunk... avoid shooting at people across parking lots... take your pick.

In fact, stuff like that often happens more deliberately than that. In deerhunting country, the power companies always run ads, or at least used to, warning deerhunters not to sight in their rifles on insulators or transformers, and promising prosecution to those who did. Perhaps they forgot to mention "phone lines" in the ad in New Mexico, and Elmer figgered it's "tewephone wine season"?

Yeah, that's what they call themselves. Hunters. People so lame they'll shoot at a stop sign because it's shaped like a target. It never ceases to amaze me that when you put a gun into the hands of someone who has never shot a weapon before, they immediately want to go outside and shoot something up as "practice". And if they are way, way out in the county, it's road sign and telephone pole season.
The most hunted game in my part of the country? Mailboxes.
Yep, the postal workers here have some stories about that one rogue mailbox that attacked a schoolbus last winter....
