Apple fights EFF attempt to open up device...

The Electronic Frontier Foundation has been busy petitioning The Copyright Office to legalize the act of iPhone jailbreaking, which gives users complete control over what applications they can run and what other networks the device runs on (assuming there are any). But in a filing, Apple lawyers are arguing that the act of jailbreaking constitutes a national security threat, and that by allowing users to alter the iPhone’s BBP (baseband processor software), all manner of nefarious activities can take root:

By tinkering with this code, “a local or international hacker could potentially initiate commands (such as a denial of service attack) that could crash the tower software, rendering the tower entirely inoperable to process calls or transmit data,” Apple wrote the government. “Taking control of the BBP software would be much the equivalent of getting inside the firewall of a corporate computer — to potentially catastrophic result.

EFF Fred von Lohmann calls Apple's claims "preposterous," noting there's an estimated one million jailbroken iPhones already in the wild, none of which have triggered wireless Armageddon. He also notes that were Apple's claims true, the open-source Android phone from Google on T-Mobile networks would be a complete menace to society.

apple also says the same crap about unlocking the phone as well.

Taking control of the BBP software would be much the equivalent of getting inside the firewall of a corporate computer. As in hacking in to the system that you own. also there other unlocked and open phones that can do a denial of service attack as well. Symbian OS, windows mobile and others don't have software store lock in.

If apple wants that level of lock down then they need to make it 100% free (as in no fee to get your app there) for free software to be in the app store.

The iPhone needs toi be jailbroken to use it to it's fullest potential. Hell I started using Google Voice on it this morning. Great stuff!

I'm so close to paying the ETF on my AT&T contract and switching to a Pre. If they wouldn't cripple useful apps like Google Voice, you wouldn't even need to jailbreak.

While I commend you for leaning towards kicking AT&T to the curb where they belong, I'd recommend waiting until September to come to Sprint because that's when the Touch Pro2 will be released. The Pre is a sweet phone (I had one so I know firsthand) but the TP2 will be far cooler in my humble opinion.

I had touch Pro with Verizon..granted not the Pro 2, but it was HORRIBLE!!! Slow, buggy and basically useless. I hope the 2 is what the Touch Pro should have been.

My Iphone 3G has been jailbroken since day 1 and i've never had a problem.

Since i'm in Canada, for some reason Robbers decided to block Skype from the App store so i had to jailbreak my iPhone and install it. Oh and thanks to jailbreaking, i'm also using Skype on Robber's 3G network. Take that you greedy corporations.

Jailbreaking is NOT a menace to society, it is a menace to big wireless telco's pockets !! THAT's what the EFF should point out in court !

I got my invite a few weeks ago but never got around to setting it up. Downloaded it from Cydia today and started messing with it. It's actually really nice, since I don't get cell service in my house. At least I can text people and they can reply back now. I have not tried out the voice part but I may cancel my skype account if it works well.

Mobile Botnets are a danger; but not just jailbroken iPhones

There is a real danger of mobile botnets to wreak havoc on the mobile networks. But that danger is not just from jailbroken iPhones. The nasty people behind PC botnets are already working to extend their controls to smartphones. Jailbroken & open platform mobile devices just make that a little bit easier is all.

Once the malware gurus start targeting mobile phones it won't just be the jailbroken ones. All mobile phones will be targeted. And with the advent of smartphones that job just got easier.

Apple has taken the risk and tied the danger to their business plan. That is a a mistake because it ties the very real danger they highlighted and trivializes it.

Interesting that you bring up the concept of "Mobile Botnets".

Stick a bunch of people in a convention with cell phones, air cards, anything that uses the cell network. The simplest DDoS ever.

ComiCon? E3? CES? Nobody could access the network...

Not necessarily. 90% of the people have unlimited SMS as part of their plans and botnets spewing SMS msgs can kill a tower. Won't show up on the phone bill at all.

Write better software?

If Apple is so concerned about a mobile user being able to access the tower software, its sound like they need to improve the software on the tower. If it's so easily hackable, perhaps they should have Microsoft look at it...they're experts at hackable systems software...

Here is a proven-working software implementation of the GSM stack that runs on a software-defined radio: »openbts.sourceforge.net/

I am sure it would be trivial to modify that to act as a GSM subscriber module and totally crash the base stations.

If true, we have bigger problems...

How is the legality of hacking your phone's OS going to prevent tower software from being attacked and "crashed"?

The iPhone has already been hacked and the threat is already real. I'm quite certain it would be very illegal to crash the cell towers by using a DDoS or other "nefarious" mechanism. The only difference would be prosecuting someone for hacking their phone AND attacking the cell phone network.

If Apple's excuse has credibility, I would be more concerned with how fragile the tower software is rather than worrying over the legality of hacking your phone's OS.

Seriously Apple... fire the marketing team. If this is the best defense they can come up with for arguing against Jailbreaking an iphone? Yeah you are paying those guys waaaayyyyyy to much.

Lets look at the logic here... wouldn't "a local or international hacker" just skip the whole Jailbreaking of an iphone part and just use a laptop with a wireless 3G card to initiate a DDOS attack? Wouldn't that be far easier since there is a full blown OS for the hackers DDOS scripts? Even better, and this I think would be the truth, which is that they would just do this from their home (basement) internet connection like I good honest hacker should?

You guys are hilarious.

I have despised the Apple marketing team ever since they forced the QuickTime developers to take away the option of removing the nag screen about updating to QT Pro several years ago. As many things as are built around QuickTime, that damn nag screen got old fast. I got to the point of avoiding apps that required QT to run. Thankfully the nag screen seems to be gone now.

Jailbreaking != Hacking the baseband

Lots of people jailbreak and leave the baseband alone. While jailbreaking is an obvious first hurdle, once jailbroken it's no different than a Blackberry or Windows Mobile device where arbitrary code can be run without authorization.

Good point on the baseband issue, though, Apple. There's a good way to stop all the baseband hacking efforts and protect national security - officially unlock the damn phone.

by insisting in a closed platform Apple doesn't make it any less 'dangerous', you just limit it to the people clever enough to break in, and you're limiting the development potential for the device. I think the work of the dev-team just proves that point time and time and again. If they're worried about iPhone's becoming security risks to the network nothing is stopping them from writing proper firewall software to avoid this sort of thing

I feel again EFF is on the wrong side, Apple has every right to dictate the policy over I-Phones. It is their property and nobody is forcing me or anybody to buy one. The lack of flexibility is one reason I will not buy and Apple product.
This is an opportunity for a competitor to offer an open version. It can be another PC vs. Apple battle. Remember what happen last time. Apple II was dominant, PC introduced as an open product, PC eventually dominates over Apple.

It's like saying Apple can tell you what you can and can't do with something they built, just because they built it and you bought it.

It's like saying that if Apple said "no alternative operating systems" I can't strip OSX off my ibook and slap a linux distro on it.

It's like saying that if Apple said "no alternative browsers" I couldn't go download Opera or Camino.

It's like saying that if Apple said "you MUST drink the kool-aid!" I couldn't refuse.

They're free to try and prevent jailbreaking, but once they sell me the phone it belongs to me. I can then do anything I want with it including jailbreaking it or throwing it into a volcano. Once I buy it Apple loses any say in what I do with it.

AT&T is admitting that the celltower security is so lame that the entire system can be brought down by a single cellphone that is hacked? Really?

This is just "semantics" really, but jailbreaking isn't illegal. Just because Apple ( or anyone) says an activity is illegal does not make said activity illegal. The "law" is there foe this purpose.
