DoubleClick Faces More Trouble in Europe than U.S.Different mergers, different countries, different rules ( old news - 05:29PM Wednesday Nov 21 2007) tags: legal · competition · business · world · GoogleTipped by LiamJunket  Googles acquisition of DoubleClick has stirred up some anti-trust concerns in the United States. However, it seems that where the deal is going to face real trouble isnt here but over in Europe. Essentially, there are two types of mergers that are looked at in anti-trust litigation (source). One is a non-horizontal merger, in which two companies in compatible but different lines of businesses are seeking to expand into new markets by merging, such as America Online's acquisition of Time Warner. The other type of merger is a horizontal merger, in which two companies in largely identical businesses are seeking to capture a larger bite of the market, as in the Oracle-PeopleSoft merger. The DoubleClick acquisition falls under the category of a non-horizontal merger. Here in the United States, those types of mergers are rarely pursued by legal authorities. However, the legal approach in Europe has differed and the European Commission is now intensively reviewing the DoubleClick acquisition. If they determine that DoubleClick could have grown large enough to compete with Google, they will consider this acquisition to be an anti-trust violation.
