Patriot Act's Author, EFF Join Forces Against NSA

Continuing to illustrate how the NSA leaks have obliterated traditional partisan lines, Patriot Act author Rep. Jim Sensenbrenner has joined forces with the EFF to argue before a court that the NSA has taken things too far. Both Sensenbrenner and the EFF have filed a joint amicus brief as part of the ACLU's lawsuit against the government for their wholesale collection of Verizon user metadata, exposed by whistleblower Edward Snowden back in June.

You might recall the countless critics who warned the government repeatedly that The Patriot Act would be abused in precisely this fashion. Sensenbrenner ignored those concerns and shot down critics repeatedly when drafting the Act, as this 2006 USA Today editorial exemplifies.

He ignored those same critics when the Patriot Act was reauthorized. Now he's seemingly amazed as the abuses he was warned repeatedly about have come to fruition.

Regardless, Sensenbrenner's presence ads heft to the EFF and ACLU's battle. While Sensenbrenner makes clear in this latest court filing he still supports the intent of the Patriot Act, both he and the EFF are asking the court to deny the NSA's motion to dismiss and grant the ACLU's motion for a preliminary injunction:

"I stand by the Patriot Act and support the specific targeting of terrorists by our government, but the proper balance has not been struck between civil rights and American security," said Sensenbrenner, who chaired the House Judiciary Committee during the Patriot Act debates. "A large, intrusive government-however benevolent it claims to be-is not immune from the simple truth that centralized power threatens liberty. Americans are increasingly wary that Washington is violating the privacy rights guaranteed to us by the Fourth Amendment."
When the creator of one of the more draconian expansions of government surveillance power in history thinks you've taken domestic spying too far -- you've probably taken domestic spying too far.

Too Late Senator

There are no do-overs Senator. You failed to learn from history that the monster you were creating would have a life of its own free of the controls of its master. There are no amount of safeguards that you will be able to put in place to tame it. Live with the fact that you made a biga$$ mistake and that history will more than likely remember you for it.

But, He right. Given all the time congress spends arguing over nothing, on those rare occasion they try to do something this big, they could/should/HAVE TO spend a little more time thinking through ALL the possible ramifications. ie what does the law allow, not just what they intended it to allow.

No one and no amount of spying will catch EVERY terrorist attack. But not spying will let dozens take place instead of an occasional successful attack.

They give conflicting accounts and are old claims already proven false. Give the last link (feinstein) a good read and you will see that the same plots they were using as justification for the domestic spying were actually discovered in other ways. In other words... they were LYING (gee, there's a shocker!) Here is the latest:

I think you misunderestimate the number of monsters the CIA/political fumbling have created over the years.
Few people REALLY paid attention to those two until it was too late. Lets not wait for the next one to make himself known to the press/general public.

A politician acting like a politician

The sad thing is that guy is just upset that the Patriot Act powers are being used by a Democrat, and not a God-fearing, upright Republican president as he intended.

If a Republican was in the office he'd be sitting quietly in a corner.
