FCC Announces Comcast, AT&T Merger Review Teams

The FCC has unveiled the list of individuals who'll be reviewing both Comcast's proposed acquisition of Time Warner Cable, and AT&T's proposed acquisition of DirecTV. Among them is William Rogerson, a former FCC staffer now a professor of Economics at Northwestern University. Rogerson was a staunch opponent of Comcast's acquisition of NBC Universal, which of course was approved anyway with largely cosmetic conditions -- most of which having been proposed by Comcast itself (which they somehow still had problems adhering to). Most analysts believe Comcast's latest deal will be approved as well, with similarly flimsy, Comcast proposed conditions.

Don't apply "rules" by merger

Requirements should not be applied via merger condition that cannot otherwise be applied in general by a rulemaking.

As it is, the merger conditions apply only to the specific companies that are merging, not to the industry in general. And merger conditions normally carry an expiration date. If a requirement is good enough to be applied in a merger, it is good enough to warrant a general rulemaking. If the law does not support a general rulemaking, then parties to a merger should not be "held hostage" by forcing them to agree to a merger condition in exchange for regulatory approval of a merger.

Merger conditions should be limited to addressing specific harms that arise as a result of the merger, nothing else.

The thing with the FCC and their "rules" is they have hardly any grounds to stand on with them. Their NN Rules? Hardly. Anything Internet related- again, nothing. CableTV- should NOT be part of them as it could be argued its not a communication service its an information service.
