FCC Won't Investigate AT&T/NSA Allegations

In a letter (pdf) sent to Democrat Ed Markey, FCC chief Kevin Martin says "the classified nature of the NSA's activities makes us unable to investigate the alleged violations." Those violations allegedly include handing over customer phone and Internet activity records wholesale to the NSA. Markey responded to Martin in a statement:
"We can't have a situation where the FCC, charged with enforcing the law, won't even begin an investigation of apparent violations of the law because it predicts that the administration will roadblock any investigations citing national security." "If the FCC initiates an investigation and gets blocked by the White House, then the White House is stonewalling. But if the FCC refuses to even demand answers, then the White House never has to block the enforcement agency from getting to the bottom of this. The American people deserve answers."
FCC Commissioner Michael Copps recently voiced his desire to see an investigation started.

As much as I dislike most of what the FCC does, I think the commissioner is right.

If you are going to make an allegation that the NSA is illegally plying their trade domestically it would have to be heard in the FISA court since they are the only judiciary with the necessary clearances. If the FISA court determines it does involve national security you likely won't hear anything about it.

I also think this has turned into a debate that can't be won by either side just like the debate on the existence of UFOs. Even if this makes it into the courts and the courts find it didn't happen, some will continue to believe the call records were turned over, simply because they are partisan or they don't trust the government.

On the other hand if the law was really broken and there is proof that extends beyond hearsay and innuendo, those responsible should be held to account.

I think the Dems will win in this one by continuing to talk about it. Don't get me wrong, it's definitely a complete violation of constiutional authority.

Glenn, you need to keep track of more things to keep it interesting.

You could double dip and keeping score on how many news posts on a given day until there is one that is bashing an administration program (or alleged program) or abuse (or alleged abuse), and then count the number of comments until there is a Bush rant.

Or triple dip: and count the number of news posts until a news post involving 1) a law suite 2) a program or abuse of the Bush administration (alleged or otherwise), and 3) a Bush bash.

Perhaps you could make a rating system using smileys?

If FCC will not do its oversight function and the U.S. Congress will not, then I guess the telecoms can become an extension of the administration or is it the reverse. The technical/engineering departments of the FCC need to be spun off into a new agency and actually staffed with technical people. They would be concerned with technical specifications, frequency allocations, and technology. Then nuke what remained of the FCC and create a non-partisan agency that is run by ten commissioners with equal numbers from both parties. This agency would be concerned with competition, markets, boobies, etc. Have the commissioners chosen by drawing straws or picking names out of a hat. Anything has to be better than the President appointing commissioners.

And its not like the Dems put up much of a competition. I mean hell there's been talk of Hillary trying to run for office. All she could ride on is the name Clinton and that isn't saying much.

Alas, it is not about 1 person anyways. Its about Congress. Congress pulls all the strings regardless of who's in office. If they want something passed they can override the president, veto or no.

The FCC's mandate doesn't include undertaking criminal investigations. That is the job of the Justice Department. I don't blame Martin one bit for not wanting to stick his nose in where his authority to do so is non-existent.

Aw, you beat me to it. The FCC is controlled by Congress, which has no authority for law enforcement. The executive branch of government is where law enforcement resides. Markey's (ed, sp) statement is pure BS.

Major areas of enforcement that are handled by the Enforcement Bureau are: (1) consumer protection enforcement; (2) local competition enforcement; and (3) public safety/homeland security enforcement.
The FCC certainly has it in their power to investigate.

Uhm, you are flat wrong in saying the FCC has no enforcement powers. Everything under the FCC guidelines, the FCC has the legal jurisdiction to enforce. In fact, the FCC has the most enforcement powers of any agency in the gov't. One thing you learn early on in getting a Ham radio license is, there is no hiding from the FCC. They will go to other countries to chase you down.
