Techdirt points to a story about a Utah ISP employee who was angry at his former employer, so he logged back into their system and screwed up the access point information for 170 customers -- knocking them offline for nearly three weeks. The former employee has since been sentenced to two years in jail for the stunt. One of those customers was relying on e-mail for news of an organ donor, according to the DOJ. Why they didn't change their passwords after this employee left and why it took them three weeks to resolve the outages isn't clear.

Why? If he had physically damaged his former employer's store, preventing them from doing business, he would have gotten jail time. I don't see this as any different.

You know, minimum security prison is no picnic. I had a client in there once. He said the trick is: kick someone's @$$ the first day, or become somebody's b1tch. Then everything will be alright.

I guess im just comparing this to some of the sentences that are issued to convicted child molesters.
We just a child molester one of our surrounding towns that only received probation for molesting an 11yr old girl. Now that's B******T and this guy gets 2yrs for screwing with someones internet connection. Our justice system is screwed up!

Just think: If he hadn't been stupid enough to sign in with his old employee ID (which should have been immediately disabled when he left) They probably would have never known what hit them (except, of course, that he was likely stupid enough to do it from his home computer, instead of the library.

Lack of thought and preparation will get you every time. He deserves the 2 years just for being a emotionally driven, unthinking moron.

A lot of libraries also require sign in, which the login name is linked to your house address.

The technician is the only one at fault in the *crime* here because he purposefully used an unsecured account to commit the crime.

Customers and customer lists are considered assets, especially in a business like this. There is a real dollar amount associated with them. It is tat amount to vandalizing a businesses's assets.

I would try to get the book thrown at anyone that did something like this to my company.

I am going to call BS. My wife's uncle is on an organ donor waiting list and they gave him a pager and they have a list of phone numbers where to reach him. E-Mail would be the LAST thing any one on an organ donor list would use to find out if they were going to get an organ.

When I did a lot of tech support I used to hear these BS stories all the time. "My dialup has to work, I am waiting on a 10 Million dollar contract!" or "We are losing thousands of dollars a minute!"

I don't believe this for one second. I don't know why people think there is a need to make their case sound extra important. We don't sit around a conference table saying "Yep that router is down. Let's go to lunch and then fix it." If something breaks I bust my ass to get it fixed as fast as humanly possible, if it's upstream from me I ask for updates but I understand that things are not always fixed with the snap of a finger, so I refrain from calling every 10 minutes for an update.

This guy deserves what he got - time in prison. Besides causing monetary damage to his ex-employer and a current competitor, he broke laws against breaking in to computer systems.

But the ISP is also at fault too. Standard employee termination procedures, even on FRIENDLY terminations and retirements, require that those with access to computer systems not only have their own computer accounts terminated, but the passwords be changed on any administrative accounts they had access to as well.

Exactly. When people are termed here either forcefully or leisurelly, their accounts are disabled in the systems and their access security for the doors are also disabled.

Failing to do this quickly - within hours of a person leaving a company on good terms or bad - is inexcusable, IMHO.

That is aggressive, but it's "business". Thankfully, I'm not the person that has to escort any employee out of the building. Sometimes it's a necessary thing to do, but it's not pleasant.

I know why it took 3 weeks to get service back

It probably took 2 weeks to process the telco disconnect order (disconnects are a low priority) and 1 week to process the reconnect order. The systems telco's used to use or still use to communicate with ISPs [and itself] are not very inflexible.

an actual appropriate use of computer crime laws. I was beginning to think they could ONLY be used for evil (like imposing criminal punishment to an employee who arguably exceeded his authority, or to people who changed configuration files on their own modems)

If you are talking about hacking a cable modem for speed,I dont think anyone would ever got to jail for something like that.

Both things I mentioned have been DSLReportsBBR news stories in the past. The cable modem story concerned Buckeye Cable. The other story concerned a sysadmin who ran one of the distributed computing clients on computers he controlled and was jailed for it.

Not only do I blame the guy but I also blame the ISP. When he was terminated they should of deleted his access and they didn't. The place where I work at, that is one of the first things they do when someone gets terminated or quits.

If this guy had access after he got fired, it makes you wonder what other things people who are not authorized can get access to.

Fisher ... went on to work for, and eventually own, another Internet service provider in the area. Fisher then used SBT’s computer passwords ...
It seems to me that a lot of time passed between his employment at SBT and his eventual crime.

IOW, this was not merely a disgruntled ex-employee acting out... this was one business sabotaging a competitor, breaking a number of laws along the way.

Of course, as everyone wants to know, why the hell didn't SBT change passwords, etc?

If you are waiting on an organ and your "best" mode of communication is some stupid po-punk ISP that can't figure out that they got hacked and takes 3 weeks to figure out it was their wireless router that was down...you might as well not get the organ.

agreed the whole "organ donor" emotional appeal is completely bogus. Wireless connections are known to be unreliable - besides, the power could have went out and prevented him from retrieving his email. His email is stored on the ISP's servers, so he could check his mail from dialup, starbucks, or even the public library. Check the WISP's TOS/EULA, etc - I guarantee they have disclaimers to guard against customer legal action in the event of inevitable interruption in internet service.

Obviously, this guy was being completely malicious and deserves due punishment.

I also see with clear vision what others point out - the company was GROSSLY negligent in not attempting to secure their assets after terminating/releasing an employee. No different than a store who gives keys to an employee, fires them and doesn't bother changing the locks on their doors.

This is a case where big lawsuits will do some good rather than harm. Sue the shit out of the WISP!

Wireless connections are known to be unreliable? Your source(s) whom are saying this are known to be uninformed.

Properly installed wireless is highly reliable, in most cases, more reliable than old copper wiring.
